0477 RESOLUTION NO. 477 01 -95
A RESOLUTION AUTHORIZING APPROVAL BY THE MAYOR AND CITY CLERK
OF THE CITY OF JACKSONVILLE, ARKANSAS, OF AN AGREEMENT i
CREATING A NEW PUBLIC RAILWAY CROSSING ON INDUSTRIAL DRIVE;
AND, FOR OTHER PURPOSES.
WHEREAS, the City of Jacksonville has authorized an
extension of Industrial Drive, creating a much demanded
thoroughfare to and from Redmond Road and West Main; and,
WHEREAS, doing so creates an additional crossing of the
Union Pacific Railroad, which requires construction, payment
of construction costs, and execution of an agreement between
the City and Union Pacific Railroad. Completion of the
Industrial Drive project is in the best interest of the
citizens and businesses of Jacksonville.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: The Mayor and City Clerk are hereby
authorized to approve an Agreement and all necessary
documents to obtain a new railroad crossing on Industrial
Drive, with said payment of the Agreement s) to require a

necessary construction required and provide acquisition of
the right of way necessary to construct, complete, and
maintain the public right of way.
SECTION TWO: All ordinances, resolutions, or parts
thereof in conflict herewith are hereby repealed to the
extent of said conflict.
SECTION THREE: This Resolution shall be in effect from
and after its date of passage.
