RESOLUTION NO. 474 (18 -94)
A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO APPROVE
AND EXECUTE ALL DOCUMENTS NECESSARY TO GRANT A RIGHT -OF -WAY/
EASEMENT FOR CERTAIN REAL PROPERTY OWNED BY CITY OF
JACKSONVILLE; AND, FOR OTHER PURPOSES.
WHEREAS, a Right - of- Way /Easement is needed to expand
operations of Texas Eastern Products Pipeline Company Limited
Partnership in our area;
WHEREAS, the City of Jacksonville, Arkansas, owns
certain real property needed for said right - of- way /easement,
of which said property is located in one of the City's former
landfills, which remains unused at this time;
WHEREAS, Federal and State officials have granted the
necessary approval for said right -of- way /easement, and
granting such will benefit our community through enhanced
service.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: The City Council hereby approves and
authorizes the Mayor and City Clerk to execute any and all
documents necessary to grant a Right -of- Way /Easement on the
property described herein for Texas Eastern Products Pipeline
Company Limited Partnership so as to allow an expansion of
operations in our Community.
1 SECTION TWO: The Mayor and City Clerk are hereby
authorized to execute and approve any and all documents
necessary to create and grant such a right -of -way /easement on
the following described real property:
A certain parcel or tract of land as more fully
described in Warranty Deed from P.W. Dupree, Sr.,
and Leonora Dupree to the City of Jacksonville,
recorded at Volume 132, Page 340 of the Deed Records
of Lonoke County, Arkansas, to which reference is
I made and is attached for further description.
SECTION THREE: All Resolutions and Ordinances and /or
parts thereof in conflict herewith are hereby repealed to the
extent of said conflict.
SECTION FOUR: This Resolution shall be in effect from
and after its date of passage.
