0471 RESOLUTION NO, 471 ( #5 -94) A RESOLUTION CONDEMNING THE STRUCTURES AND REAL PROPERTY AT VARIOUS UNINHABITED LOCATIONS THROUGHOUT JACKSONVILLE, ARKANSAS, FOR STRUCTURAL DEFECTS, DEFICIENCIES, AND PUBLIC HAZARD; AND, FOR OTHER PURPOSES. WHEREAS, THE UNINHABITED STRUCTURES AND REAL PROPERTY LOCATED AT THE FOLLOWING LOCATIONS WITHIN THE CITY OF JACKSONVILLE, OWNED BY THE VARIOUS PARTIES AS CITED BELOW, CONSTITUTE A HEALTH AND SAFETY HAZARD TO THE GENERAL PUBLIC DUE TO THE LACK OF STRUCTURAL SOUNDNESS AND DILAPIDATED CONDITIONS WHICH EXIST IN THE VARIOUS BUILDINGS AND IMPROVEMENTS THEREON. THE PROPERTIES AND OWNERS INVOLVED ARE AS FOLLOWS: PROPERTY ADDRESS OWNER 600 BEVERLY WILLIAM BURKS 902 CHURCH STREET NATHANIEL JARRETT 1015 GOSHEN HARRY HARRELL CARTER ROAD - (O'NEAL PROPERTY) ADMINISTRATOR - JAMES A. CARTER 106 ROOSEVELT CIRCLE FRANK CAVENDER 171 ROOSEVELT ROAD JERRY TALLEY 200 ROOSEVELT ROAD GLENN DAVIDSON 129 UNION DELORES CARROLL 105 VICTORY CIRCLE GLENN DAVIDSON AND, WHEREAS, DESPITE NOTICE AND DEMAND, SAID PROPERTY OWNERS HAVE NOT REPAIRED THEIR RESPECTIVE PROPERTIES, STRUCTURES, AND /OR REMOVED THE DETERIORATED ELEMENTS SO AS TO ELIMINATE THE PUBLIC HEALTH AND SAFETY HAZARDS, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT: SECTION ONE IN ACCORDANCE WITH JACKSONVILLE MUNICIPAL CODE SECTION 8.26,010 ET, SEQ., THE FOLLOWING STRUCTURES AND REAL PROPERTIES, LOCATED AT 600 BEVERLY, 902 CHURCH STREET, 1015 GOSHEN, RAY ROAD (O'NEAL PROPERTY), 106 ROOSEVELT, 171 ROOSEVELT, 200 ROOSEVELT, 129 UNION, AND 105 VICTORY CIRCLE, IN JACKSONVILLE, ARKANSAS, ARE HEREBY DECLARED TO EACH CONSTITUTE A SEPARATE NUISANCE TO THE HEALTH AND SAFETY OF THE CITIZENS OF JACKSONVILLE, THE CITY COUNCIL HEREBY DIRECTS THE CODE ENFORCEMENT OFFICE TO PROVIDE NOTICE TO THE PROPERTY OWNERS AND ALL OTHER INTERESTED PARTIES (AS CITED ABOVE) THAT, IF SAID STRUCTURES AND REAL PROPERTY ARE NOT REPAIRED AND /OR THE HEALTH AND SAFETY HAZARDS REMOVED FROM SUCH WITHIN THIRTY (30) DAYS FROM THE DATE OF PASSAGE OF THIS RESOLUTION, THE STRUCTURES AND REAL PROPERTY CITED ABOVE WILL BE CLEARED, ALL STRUCTURES AND NUISANCES SHALL BE REMOVED SO AS TO ELIMINATE ANY HEALTH OR SAFETY HAZARDS TO THE GENERAL PUBLIC. SECTION TWO IF THE CITY OF JACKSONVILLE IS REQUIRED TO UNDERTAKE AND /OR COMPLETE REMOVAL OF HAZARDOUS CONDITIONS FROM THE REAL PROPERTIES IN QUESTION, THE CITY WILL THEN FILE A LIEN AGAINST THE RESPECTIVE REAL PROPERTY INVOLVED FOR COLLECTION OF ALL REASONABLE COSTS INCURRED TO UNDERTAKE AND COMPLETE THE REMOVAL OF SAID HAZARDOUS CONDITIONS ON THAT PROPERTY, RESOLUTION No. 471 ( #5 -94) PAGE Two SECTION THREE: ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN CONFLICT HEREWITH ARE HEREBY REPEALED TO THE EXTENT OF SAID CONFLICT.
