1 RESOLUTION NO. 459 ( #1 -93)
A RESOLUTION ACKNOWLEDGING THE NECESSITY FOR ACQUISITION OF
RIGHTS -OF -WAY ON REAL PROPERTY FOR THE CONSTRUCTION OF A
DRAINAGE DITCH IN SUNNYSIDE HILLS ADDITION FROM ROOSEVELT
1 ROAD NORTH TO GALLOWAY CIRCLE; GRANTING AUTHORIZATION TO THE
CITY ENGINEER FOR CERTIFICATION OF APPRAISALS AND ESTABLISH-
MENT OF JUST COMPENSATION AMOUNTS FOR SAID RIGHT -OF -WAY
ACQUISITIONS; AND, FOR OTHER PURPOSES.

WHEREAS, the City of Jacksonville's Community
Development Agency proposes construction of a concrete -lined
drainage ditch in Sunnyside Hills Addition to the City of
Jacksonville; and,
WHEREAS, the Uniform Relocation Assistance and Real
Property Acquisition Policies Act of 1970, as amended,
establishes uniform policies and requirements for acquisi-
tion of real property under all federally assisted programs
subject to said Act; and,
WHEREAS, a recipient of Community Development Block
Grant funds is required to certify appraisals and establish
just compensation amounts for property acquired in connection
with any project utilizing said funds.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: The acquisition of certain easements and
rights -of -way in the Sunnyside Hills Addition is hereby
acknowledged to be essential to the construction of a
proposed drainage ditch and is in the best interest, health,
and safety of the citizens of Jacksonville, Arkansas.
SECTION TWO: The City Engineer is hereby authorized to
certify appraisals and establish just compensation amounts
for said easements and rights -of -way in accordance with
requirements of the Uniform Relocation Assistance and Real
Property Acquisition Policies Act of 1970, as amended.
SECTION THREE: This Resolution shall be in effect from
and after its date of passage.
SECTION FOUR: All Resolutions or parts of Resolutions
in conflict herewith are hereby repealed to the extent of
said conflict.
