0458 RESOLUTION NO. 458 ( #16 -92) A RESOLUTION SUPPORTING THE PASSAGE OF A ONE PERCENT SALES TAX AND RESCISSION OF THE FIVE MILL REAL PROPERTY TAX; CONFIRM A DECLARATION NOT TO REINSTATE THE FIVE MILL REAL PROPERTY TAX UPON PASSAGE OF THE ONE PERCENT SALES TAX; AND, FOR OTHER PURPOSES. WHEREAS, the City Council of the City of Jacksonville, Arkansas, passed on November 5, 1992, Ordinance No. 982 providing for the rescission of a five mill real property tax upon passage of a one percent sales and use tax within the City of Jacksonville; and, WHEREAS, said funds are to be used to develop and fund a multi- purpose community center, provide improvement of general municipal services, develop other capital improvement projects for the City, and shall serve as a continuing source of reve- nue to finance these capital improvements and services; and, WHEREAS, the great need of a multi- purpose community center in the City of Jacksonville has encouraged the support, pledge, and declaration that this City Council will not reinstate the five mill real property tax if the electorate of Jacksonville support and pass the one percent sales and use tax as proposed on the January 7, 1993 ballot. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT: SECTION ONE: The City Council of the City of Jacksonville hereby reasserts and declares its support of the proposed multi - purpose community center and the proposed one percent sales and use tax method of funding development and construction of said center. SECTION TWO: The City Council further reasserts and declares that it will not reinstate the five mill real property tax rescinded upon passage of the one percent sales and use tax. The Council confirms its declaration as stated in Ordinance No. 982 to rescind the five mill real property tax upon passage by the electorate of the City of a one percent sales and use tax. SECTION THREE: All Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of said conflict. SECTION FOUR: This Resolution shall take effect immediately upon its passage, as provided by and subject to applicable law. APPROVED AND ADOPTED THIS / ? • DAY OF DECEMBER, 1992.
