RESOLUTION NO. 632 ( #11 - 2009)
A RESOLUTION AUTHORIZING AND SUPPORTING THE JACKSONVILLE WATER
COMMISSION IN ITS EFFORTS TO PARTICIPATE IN THE MID ARKANSAS WATER
ALLIANCE; AND, FOR OTHER PURPOSES.
WHEREAS, through creation of and participation in the Mid - Arkansas Water Alliance
(MAWA), the Jacksonville Water Commission has secured a proportional allocation of water
available for the City of Jacksonville through Greers' Ferry Lake allocated to municipal and
industrial water supply;
WHEREAS, the City of Jacksonville, Arkansas, designated as a Member in said Alliance
through the Jacksonville Water Department, wishes to enter into an Agreement providing for the
purchase of proportional undivided interests in the joint- storage space reserved to MAWA and
agrees to share in the costs of operation proportional to its Membership Shares; and,
WHEREAS, the Jacksonville City Council understands and agrees that a binding
agreement will obligate all parties to certain policies and procedures contained in the
development and participation of MAWA, its proportional share of the allocation and costs
associated therewith, and with the terms of the Storage Agreement between the parties.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: The City Council of the City of Jacksonville, Arkansas, hereby
authorizes and supports the Jacksonville Water Commission in its efforts to obtain water
allocation privileges in the Mid - Arkansas Water Alliance (MAWA). The City Council understands
the necessity for the City of Jacksonville to purchase a proportional allocation of municipal and
industrial water supply rights from those available through water availability in Greers' Ferry
Lake under certain terms and conditions as set forth by written Agreement between the parties,
and supports the Jacksonville Water Commission's efforts and means to do so as a means of
securing a sufficient and necessary water supply source for the well -being and future of the
citizens of Jacksonville. The Mayor and City Clerk are hereby authorized to execute and
authorize any and all necessary documents to insure the City of Jacksonville's participation in
said Alliance.
SECTION TWO: Any and all other Resolutions in conflict herewith are hereby
repealed to the extent of said conflict. This Resolution shall be in effect from and after its date
of passage.
