0631 RESOLUTION NO. 631 ( #10 - 2009) A RESOLUTION TO HELP IMPROVE RECREATION FACILITIES FOR THE CITIZENS OF JACKSONVILLE AND TO SEEK GRANT FUNDING ASSISTANCE FOR JACKSONVILLE PARKS AND RECREATION DEPARTMENT; AND, FOR OTHER PURPOSES. WHEREAS, Jacksonville Parks and Recreation Department seeks to improve recreational facilities within the City and wishes to seek grant funding assistance to do so; WHEREAS, to obtain possible funds necessary to develop and /or improve recreational facilities, it is necessary to obtain a 50/50 Matching Grant from the Arkansas Department of Parks and Tourism's Outdoor Recreation Grant Program; WHEREAS, the City Council understands and agrees that a binding agreement will obligate both parties to certain policies and procedures contained in the Land and Water Conservation Fund Grants Manual including, but not limited to, the following: the designated park area must be defined by a project boundary map, submitted with the application, and said property must remain outdoor recreational property in perpetuity, regardless of whether the property is bought or developed with matching grant funds or not; all present and future utility lines within the project boundary must be routed away from the property or placed underground; the project area must remain open and available for use by the public at reasonable times of operation; said facilities can be reserved for special events, league play, and other limited uses, but will not be reserved, leased, or assigned for exclusive use by one entity; and, the project area must be kept clean, maintained, and operated in a safe and . -- healthful manner; and, WHEREAS, the Jacksonville City Council is well aware and apprised of the above- mentioned project, and the Council agrees to provide the necessary local portion of the development cost of the entire project. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT: SECTION ONE: The City Council of the City of Jacksonville, Arkansas, hereby authorizes the Mayor and /or his designated representative(s) to submit an Application for grant funding to the Arkansas Department of Parks and Tourism under the terms and conditions as authorized above. SECTION TWO: Any and all other Resolutions in conflict herewith are hereby repealed to the extent of said conflict. This Resolution shall be in effect from and after its date of passage.
