RESOLUTION NO, 629 ( #8 - 09)
A RESOLUTION AUTHORIZING THE MAYOR OF THE CITY OF
JACKSONVILLE, ARKANSAS, TO EXECUTEA CONTRACT OF OBLIGATION
BETWEEN THE JACKSONVILLE WASTEWATER UTILITY AND THE
ARKANSAS DEPARTMENT OF ENVIRONMENTAL QUALITY AND, FOR
OTHER PURPOSES.
WHEREAS, the Jacksonville Wastewater Utility has submitted to the
Arkansas Department of Environmental Quality a permit application for the
operation and maintenance of its solid waste disposal and processing facility
pursuant to the requirements of the Arkansas Solid Waste Management Act; and,
WHEREAS, in lieu of a performance bond, the Utility desires to execute a
"Contract of Obligation" with the Arkansas Department of Environmental Quality
to provide financial assurance for corrective actions, closure, or post - closure care
of a solid waste disposal or processing facility.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: The Mayor is hereby authorized to update and
execute a Contract of Obligation with the Arkansas Department of Environmental
Quality in lieu of a performance bond for the operation and maintenance of the
Jacksonville Wastewater Utility's Solid Waste Disposal and Processing Facility.
SECTION TWO: Any and all other Resolutions in conflict herewith are
hereby repealed to the extent of said conflict. This Resolution shall be in effect
from and after its date of passage.
