RESOLUTION NO. 563 ( #8 - 02)
A RESOLUTION SUPPORTING PARTICIPATION OF THE CITY OF
JACKSONVILLE, BY AND THROUGH THE JACKSONVILLE
WASTEWATER UTILITY, IN THE VALENTINE/WOOTEN ROAD SEWER
PROJECT; AUTHORIZING A DEFERRED LOAN AGREEMENT WITH
THE ARKANSAS SOIL AND WATER CONSERVATION COMMISSION;
AND, FOR OTHER PURPOSES.
WHEREAS, residents of the Valentine /Wooten Road area have formed an
association in efforts to obtain sewer service in said area and have qualified for
a deferred loan program through the Arkansas Soil & Water Commission;
WHEREAS, said loan agreement requires the City of Jacksonville, by and
through its Wastewater Utility, to accept the sewer project once completed,
execute a Deferred Loan Agreement, establish and maintain a depreciation
fund, and collect fees paid by said users and forward said monies to the
Arkansas Soil and Water Commission until the loan amount is paid in full; and,
WHEREAS, the Jacksonville Sewer Commission recommends
participation and ultimate acceptance of said project, execution of the
appropriate loan documents required, and collection and reimbursement to
Arkansas Soil & Water Commission of the payments received by Utility
customers from the Valentine /Wooten Road area. The Sewer Commission
specifically notes that the users of said system will pay the costs associated
with its construction, and the additional charges associated incurred by the
Jacksonville Wastewater Utility will only be collected from those Utility
customers from the Valentine /Wooten Road Sewer Project.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: The City of Jacksonville, by and through the
Jacksonville Wastewater Utility, is hereby authorized to participate in the
Valentine /Wooten Road sewer project, and the Mayor, City Clerk, and /or their
designated representative(s) are hereby authorized to execute the Deferred Loan
Agreement and other appropriate documentation required to secure the City's
rights and obligations under the financial terms and conditions of said project.
SECTION TWO: Any and all other Resolutions in conflict herewith are
hereby repealed to the extent of said conflict. This Resolution shall be in effect
from and after its date of passage.
