A RESOLUTION SUPPORTING LEGISLATION ALLOWING LOCAL
•
GOVERNMENTS TO ENTER INTO A NON-DISCLOSURE AGREEMENT
WITH THE ARKANSAS DEPARTMENT OF FINANCE AND
ADMINISTRATION REGARDING LOCAL SALES TAX COLLECTION
INFORMATION; AND, FOR OTHER PURPOSES.
WHEREAS, local sales and use taxes provide vital revenue sources for
the support of basic governmental services enjoyed by citizens of local
communities throughout Arkansas;
WHEREAS, local sales and use taxes are collected on behalf of local
governments by the Arkansas Department of Finance and Administration
(ADFA). In exchange for doing so, ADFA retains three percent (3 %) of such local
sales and use taxes as reimbursement of the costs associated with the
collection and accounting disclosure requirements; and,
WHEREAS, ADFA does not currently provide adequate accounting
information regarding the collection and administration of local sales and use
taxes to local jurisdictions, so legislation should be enacted permitting the
execution of a non - disclosure agreement between local governments and ADFA
in order to provide full and complete disclosure of information regarding local
sales tax collections.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: The City of Jacksonville hereby supports legislation
urging the revision of collection, administration procedures, and accounting
report requirements for local sales and use taxes by ADFA through
authorization of a non - disclosure agreement between the Arkansas Department
of Finance and Administration and local governments permitting release of local
sales tax collection information to individual mayors and /or his /her designated
representative.
SECTION TWO: Any and all other Resolutions in conflict herewith are
hereby repealed to the extent of said conflict. This Resolution shall be in effect
from and after its date of passage. 1
