RESOLUTION NO. 614 ( #7 - 2008)
A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO NEGOTIATE
AND EXECUTE ALL NECESSARY DOCUMENTS IN EFFORTS TO SECUREA LONG
TERM LEASE FOR OPERATION OF THE RAILROAD LINES AND SPURS IN THE
JACKSONVILLE INDUSTRIAL PARK; AND, FOR OTHER PURPOSES.
WHEREAS, the City of Jacksonville is desirous of obtaining a long term lease for the
operation on the Railroad lines and spurs located throughout the Jacksonville Industrial Park to
support local industries and meet their needs for transportation of goods and products; and,
WHEREAS, the City of]acksonville understands that Arkansas Midland Railroad Co., Inc.,
is willing to operate the railroad lines and spurs owned by the City in the Jacksonville Industrial
Park. As such, the Mayor and City Clerk should be authorized to negotiate with Arkansas
Midland Railroad Co., Inc. and /or its successor in interest and be authorized to execute any and
all relevant documents to obtain and grant a long term lease for maintenance and operation of
said lines and spurs.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: To satisfy the needs of local industries and businesses located
within the Jacksonville Industrial Park, the Mayor and City Clerk are hereby authorized and
directed to negotiate with Arkansas Midland Railroad Co., Inc., and /or its successor in interest
and to execute all appropriate agreements and documents necessary to obtain and secure a
long term lease for the maintenance and operation of the railroad spurs and lines owned by the
City located in the Jacksonville Industrial Park.
SECTION TWO: Any and all other Resolutions in conflict herewith are hereby
repealed to the extent of said conflict. This Resolution shall be in effect from and after its date
of passage.
