0594 RESOLUTION NO, 594 ( #7 — 06)
A RESOLUTION OPPOSING ANNEXATION OF CERTAIN REAL PROPERTY
INTO THE CITY OF SHERWOOD, ARKANSAS; AND, FOR OTHER PURPOSES.
WHEREAS, the City of Jacksonville, Arkansas, has planning jurisdiction
extending Five (5) miles from its corporate limits, and both the Water and
Wastewater Utilities have developed Master Plans to include extending service to
portions of said area;
WHEREAS, the Jacksonville Water Department has territorial rights and
obligations to provide or have the option to provide water service to certain areas
within the extra- territorial planning jurisdiction; and,
WHEREAS, certain landowners have filed a petition with the Pulaski County
Court to allow annexation of property beyond the natural boundary of Bayou Meto,
which includes property within the planning jurisdiction and potential service areas
of the City of Jacksonville, Arkansas.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: Annexation of property as more particularly described on
the attached map, which lies within potential areas of service for the Jacksonville
Water Department and Jacksonville Wastewater Utility as well as the City of
Jacksonville extra- territorial planning jurisdiction, is neither productive nor beneficial.
Planning jurisdiction and utility service to these areas, other than through a private
utility improvement district, is statutorily and constitutionally appropriate for the
Jacksonville Planning Commission, Jacksonville Water Department, and the
Jacksonville Wastewater Utility. As such, the Jacksonville City Council opposes any
proposed annexation of real property that is included within these potential service
areas and extra- territorial planning jurisdiction as reflected on the attached map.
SECTION TWO: The Mayor, City Clerk, and /or their authorized
representatives are requested to appear and voice opposition to the proposed
annexation at the public hearing to be held on June 20, 2006. Further, it is directed
that a certified copy of this Resolution be submitted as evidence at said hearing as
an expression of additional opposition to the proposed annexation.
SECTION THREE: Any and all other Resolutions in conflict herewith are
hereby repealed to the extent of said conflict.
SECTION FOUR: This Resolution shall be in effect from and after its date
of passage.
