RESOLUTION NO, 592 ( #5 - 06)
A RESOLUTION AUTHORIZING DEANNEXATION AND DETACHMENT OF
CERTAIN UNIMPROVED AND UNINHABITED WETLANDS FROM THE CITY
OF JACKSONVILLE, ARKANSAS; AND, FOR OTHER PURPOSES.
WHEREAS, the owners of certain lands described by a metes and bounds
description and as shown on the attached plat, which description and plat are
incorporated by reference herein, have requested deannexation and detachment of
the described lands from the City of Jacksonville, pursuant to law; and,
WHEREAS, Act 140 of 1997 permits the detachment of unimproved and
uninhabited wetlands upon resolution of the appropriate City government and
concurrence of the appropriate County court.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: The lands owned by Holland Bottoms, L.L.C. and
described below and on the attached plat are found and determined to be
unimproved and uninhabited wetlands, and should be and are hereby deannexed
and detached from the City of Jacksonville, Arkansas.
SECTION TWO: The lands deannexed and detached are more particularly
described as follows:
A tract of land located in the Southeast Quarter (SE 1/4) of the
Northwest Quarter (NW 1/4) of Section 21, Township 3 North, Range
10 West, in the City of Jacksonville, Pulaski County, Arkansas, being
more particularly described as follows:
Commence at the SW corner of said NW 1/4 of Section 21, T -3 -N, R-
10-W; thence S 89° 05' 00" E, 1124.58 feet along the South line of
said NW 1/4; thence N 00° 39' 39" E, 18.84 feet; thence S 87° 51' 00"
E, 130.92 feet to the point of beginning; thence S 89° 05' 00" E, 1320
feet; thence N 01° 23' 23" E, 990 feet; thence N 89° 05' 00" W, 1320
feet; thence S 01 23' 23" W, 990 feet to the point of beginning;
containing 30 acres, more or less.
SECTION THREE: The Pulaski County Court is respectfully requested to
concur and approve such deannexation and detachment after notice as required by
law.
SECTION FOUR: Any and all other Resolutions in conflict herewith are
hereby repealed to the extent of said conflict. This Resolution shall be in effect from
and after its date of passage.
