0558 RESOLUTION NO. 558 ( #3 - 02)
A RESOLUTION URGING SUPPORT OF THE PROPOSED ANNEXATION OF
VARIOUS REAL PROPERTY LOCATED ON THE SOUTH SIDE OF JACKSONVILLE
COMMONLY KNOWN AS THE SOUTH ANNEXATION; AND, FOR OTHER
PURPOSES.
WHEREAS, a majority of the residents of the South side of Jacksonville desire that
their real properties be annexed into the city limits of the City of Jacksonville, Arkansas;
WHEREAS, the City of Jacksonville, Arkansas, is the adjoining and surrounding duly
organized municipality within Pulaski County to said properties; and,
WHEREAS, the City of Jacksonville, Arkansas, and a majority of the real estate
owners of the South side of Jacksonville are in agreement that annexation of the property
located on the South side of Jacksonville, as more particularly described below, would be
advantageous and beneficial to all parties concerned.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: The City Council wholeheartedly urges support and approval
of the proposed annexation of the real property located on the South side of Jacksonville,
as shown on the attached map (identified as Attachment "A" and made a part hereof).
SECTION TWO: The following real property, as more particularly described
below and as shown on the attached map, shall be annexed and accepted by the City of
Jacksonville, Arkansas:
SOUTH SIDE PROPERTY
Property on the South side of the City of Jacksonville, Arkansas, along the
North and West sides of the Union Pacific Railroad to the South side to One
Quarter (1/4) mile South of Wooten Road, more particularly described as follows:
Beginning at the SW corner of the NE 1/4 of the NE 1/4 of Section 2,
Township 2 North, Range 11 West; thence East on the South line of the NE
1/4 of the NE 1/4 to the East line of the W 1/2 of the NE 1/4 of the NE 1/4;
thence North along the East line of the W 1/2 of the NE 1/4 of the NE 1/4
to a point 300' South of the South and East Right -of -Way line of the Union
Pacific Railroad; thence Northeasterly parallel to the South and East Right -
of -Way line of the Union Pacific Railroad to the East Tine of Section 2,
Township 2 North, Range 11 West; thence South along the East line of said
Section to the Southeast corner of the NE 1/4 of the NE 1/4 of Section 11,
Township 2 North, Range 11 West; thence West along the South line of the
N 1/2 of the NE 1/4 of Section 11, Township 2 North, Range 11 West to the
West line of the NE 1/4 of Section 11, Township 2 North, Range 11 West;
thence North along the West line of the NE 1/4 of Section 11, Township 2
North, Range 11 West to the South line of Section 2, Township 2 North,
Range 11 West; thence North along the West line of SE 1/4 of Section 2,
Township 2 North, Range 11 West to the Northerly Right -of -Way line of
State Highway 161; thence Westerly along the North Right -of -Way line a
distance of 85.56'; thence N 0° 50' 51" W to the South line of the NE 1/4
of the SW 1/4 of Section 2, Township 2 North, Range 11 West; thence West
along the South line of the NE 1/4 of the SW 1/4 of Section 2, Township 2
North, Range 11 West to the North and West Right -of -Way line for Union
Pacific Railroad; thence Northeasterly along the Union Pacific Right -of -Way
line to the Southwest corner of the NE 1/4 of the NE 1/4 of Section 2,
Township 2 North, Range 11 West and the point of beginning.
SECTION THREE: The Mayor, City Clerk, and City Attorney are hereby authorized
to prepare, execute, and file the appropriate documents required to complete said
annexation process.
SECTION FOUR: Upon approval of said annexation by the Pulaski County
I Judge, F. G. (Buddy) Villines, the City Council hereby agrees to authorize, accept, and
approve the annexation of the above described property by the City of Jacksonville.
SECTION FIVE: Any and all resolutions or parts of resolutions in conflict
herewith are hereby repealed to the extent of said conflict.
SECTION SIX: This Resolution shall have full force and effect immediately after
its passage.
