.4 RESOLUTION SETTING .4 PUBLIC HEARING TO ADDRESS THE ISSUE OF
ABANDONING AN OLDER PUBLIC RIGHT OF WAY EASEMENT ON LOTS 13 AND 14 OF
THE MARSHALL ROAD INDUSTRIAL PARK, JACKSONVILLE, ARKANSAS (GENERAL
LOCATION: LOTS 13 AND 14 MARSHALL ROAD INDUSTRIAL PARK); AND, FOR OTHER
PURPOSES.
WHEREAS, an older public right of way designed for placement of water lines across Lots
13 and 14, Marshall Road Industrial Park have been substituted; are not being used by the
Jacksonville Water Department; and,
WHEREAS, the Jacksonville Water Commission and City Council wish to obtain public input
as to the possible abandonment and closing of the specified easements across Lots 13 and 14,
Marshall Road Industrial Park.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
7ACKSONVILLE,ARKANSAS, THAT:
SECTION ONE: A public hearing will be held on Thursday, August 16, 2001, at 7:00
p.m., or as soon thereafter as possible, to address the issue of abandoning an older public right
of way water easement across Lots 13 and 14 of Marshall Road Industrial Park. Said public
hearing shall be held during the regular City Council Meeting in the Council Chambers of the
Jacksonville City Hall, #1 Municipal Drive, Jacksonville, Arkansas.
SECTION TWO: The real property involved is more particularly described as follows:
Part of the Marshall Road Industrial Park in the Southeast Quarter of Section 13,
T -3 -N, R -11 -W, Jacksonville, Pulaski County, Arkansas, being more particularly
described as follows:
Commencing at the Northwest Corner of Lot 13 of the Marshall Road Industrial
Park (Lots 7 -16) as recorded as Instrument No. 85 -60858 in Plat Book B, Page 675,
Pulaski County Circuit Clerk's Office, thence S 88° 28' 00" East along the North line
of said Lot 13 to the center line of an easement being 7.5 feet each side of the
following described center line; thence S 20° 07' 42" East a distance of 278.00 feet
to a point on the South line of Lot 14, Marshall Road Industrial Park and the
termination of this easement.
(GENERAL LOCATION: Lots 13 and 14, Marshall Road Industrial Park, Jacksonville,
Arkansas.) This description pertains only to the waterline constructed for the
Arkansas Ordinance Plant which traverses Lots 13 and 14 in Marshall Road
Industrial Park
SECTION THREE: The City Clerk is hereby directed to publish notice of said Public
Hearing in a newspaper having general circulation within the City of Jacksonville a minimum of two
(2) times. The first publication shall be no later than fifteen (15) days prior to said Public Hearing.
SECTION FOUR: All Resolutions or parts of Resolutions in conflict herewith are hereby
repealed to the extent of said conflict.
