0794 ,~3 ORDINANCE NO. 794 AN ORDINANCE TO PROVIDE CITY PERMITS FOR BUSINESSES IN THEIR COMPLIANCE WITH THE RESEARCH CONSERVATION RECOVERY ACT FOR THE UNDERGROUND STORAGE OF FLAMMABLE AND COMBUSTIBLE LIQUIDS; TO DECLARE AN EMERGENCY; AND FOR OTHER PURPOSES. WHEREAS, the federal laws concerning the regulation of underground storage tanks have been expanded to include those tanks used in the storage of flammable and combustible liquids; WHEREAS, the State Fire Code S20.201 prohibits the storage of flammable and combustible liquids in above ground tanks out- side of buildings and requires the removal or safeguard of any abandoned tanks; and WHEREAS, local businesses have expressed their concern over the conflict in complying with the federal regulations and State laws; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT: SECTION 1: All businesses within the Jacksonville City limits that store flammable and combustible liquids in underground tanks will be required to apply for a permit issued by the City Engineer before any removal or safeguarding proce- dures of underground storage tanks begins. SECTION 2: Each permit issued shall allow for the tem- porary storage of flammable and combustible liquids in above ground tanks in compliance with the National Fire Prevention Association guidelines for a period of fourty-five (45) days. SECTION 3: A permit shall be issued only to those busi- nesses that are taking the necessary and proper steps to comply with the revised federal regulations regarding the storage of flammable and combustible liquids in underground tanks. SECTION 4: An extension period of thirty (30) days may be granted at the discretion of the City Engineer. SECTION 5: Because of the nature of the health and safety hazards which exists, it is declared that a hazard to the life, health and welfare of the citizens of the City of Jacksonville exists. It is, therefore, declared that an emergency exists and this Ordinance, being necessary for the immediate needs of the public health and safety, shall take effect and be in force from and after its passage. SECTION 6: That all ordinances, resolutions or parts thereof in conflict herewith are hereby repealed. PASSED THIS 19th DAY OF SEPTEMBER , 1985.
