ORDINANCE NO. 7 9 3 (#26-85)
AN ORDINANCE TO PROHIBIT THE SALE, POSSESSION, EXPLOSION OR
DISCHARGE OF ANY FIREWORKS OR LIKE SUBSTANCES WITHIN THE CITY
LIMITS OF THE CITY OF JACKSONVILLE, ARKANSAS; DECLARING AN
EMERGENCY; AND FOR OTHER PURPOSES.
WHEREAS, in the past there has been a great deal of con-
fusion and problems involved with the sale, possession and use of
fireworks within the city limits of the City of Jacksonville,
Arkansas; and
WHEREAS, the citizens of Jacksonville have expr~ssed their
concern over the health, safety and welfare of the population due
to the danger and confusion created by the sale, possession and
use of fireworks within the city limits of Jacksonville; and
WHEREAS, the City Council of the City of Jacksonville has
examined the issue of fireworks within the city limits and has
concluded that the safety and welfare of the citizens of
Jacksonville warrants a prohibition against the sale, possession
and use of any fireworks within the city limits.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION 1: It is prohibited to sell, possess, explode, or
discharge any fireworks or like substances within the city limits
of the City of Jacksonville, Arkansas.
SECTION 2: All ordinances or parts of ordinances in
conflict herewith are hereby repealed to the extent of any such
conflict, except as otherwise provided.
SECTION 3: Whereas, there exists an emergency situation
as a result of the confusion and problems involved with the sale,
possession and use of fireworks and the impact made on the
health, safety and welfare of the citizens of Jacksonville, it is
necessary for the protection of the citizens that this Ordinance
have immediate effect. We hereby declare an emergency to exist.
