AN ORDINANCE TO ACCEPT A WAIVER OF NOTICE FROM THE OWNERS AND
LIENHOLDERS OF REAL PROPERTY LOCATED AT 110 ESSEX COURT,
JACKSONVILLE, ARKANSAS, AND AUTHORIZE THE REMOVAL OF ANY AND ALL
HAZARDOUS CONDITIONS THAT EXIST ON SAID PROPERTY; TO DECLARE AN
EMERGENCY; AND FOR OTHER PURPOSES.
WHEREAS, the City Council of the City of Jacksonville,
Arkansas has been contacted by numerous citizens concerning the
condition of the property located at 110 Essex Court, Stonewall
Subdivision, Jacksonville, Arkansas; and
WHEREAS, an inspection of the property brought to the City
Council's attention the health and safety hazard that the pro-
perty creates; and
WHEREAS, the City Council of the City of Jacksonville,
Arkansas has received waivers from the property owners and
lienholders; and
WHEREAS, the City Council of the City of Jacksonville,
Arkansas is desirous of eliminating all public health and safety
hazards within the City limits so as to provide a clean and safe
environment for its citizens;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS, THAT:
Section 1: The City Council of the City of Jacksonville,
Arkansas accepts the waivers of the property owners and known
lienholders of real property located at 110 Essex Court,
Jacksonville, Arkansas.
Section 2: The City Council of the City of Jacksonville,
Arkansas hereby authorizes the removal and destruction of any and
all hazardous conditions that exist on the real property located
at 110 Essex Court, Jacksonville, Arkansas by whatever means
necessary.
Section 3: Because of the nature of the health and safety
hazards which exist on the property involved, it is declared that
a hazard to the life, health and welfare of the citizens of the
City of Jacksonville exists. It is, therefore, declared that an
emergency exists and this Ordinance, being necessary for the
immediate needs of the public health and safety, shall take
effect and be in force from and after its passage.
Section 4: That all ordinances, resolutions and parts
thereof in conflict herewith are hereby repealed.
