A RESOLUTION EXPRESSING SUPPORT AND ACCEPTANCE OF THE LOCATION OF THE
PROPOSED CLASS I LANDFILL EXPANSION AREA BY WASTE MANAGEMENT, INC,;
AND, FOR OTHER PURPOSES.
WHEREAS, the City of Jacksonville, Arkansas, acknowledges that Waste Management, Inc.
(WMI) owns and operates a Class I Sanitary Landfill in Pulaski County, Arkansas, located in Section
2, Township 2 North, Range 11 West, and Section 35, Township 3 North, Range 11 West. The
existing WMI Class I Landfill currently operates in accordance with Solid Waste Permit #263 -S -R1,
originally issued in November 1979 by the Arkansas Department of Pollution Control and Ecology
(ADPC &E), now known as the Arkansas Department of Environmental Quality (ADEQ);
WHEREAS, WMI desires to expand their existing landfill operation to include the planning,
permitting, design, and development of a Class I Municipal Solid Waste Landfill adjacent to the
existing permitted sanitary landfill area presently owned by WMI. Pursuant to Arkansas Regulation
22, the Class I Landfill will accept only Class I Solid Waste (as defined by Arkansas Regulation 22);
WHEREAS, in accordance with ACA § 8 -6 -1501 and Arkansas Regulation 22.205, the City
of Jacksonville hereby acknowledges that a rebuttable presumption exists against permitting the
construction or operation of any new landfill within twelve (12) miles of any existing high- impact
solid waste facility or permitting an expansion of landfill capacity for an existing landfill; and,
WHEREAS, the City of Jacksonville, Arkansas, the nearest governmental unit to said
Landfill, as measured along major facility access roads and highways, possesses zoning authority
encompassed within a radius that includes the proposed Class I Landfill site.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: The City of Jacksonville, Arkansas, hereby recognizes and agrees to
accept and support the proposed location for WMI's proposed Class I Municipal Solid Waste Landfill
adjacent to the Two Pine Sanitary Landfill as allowed in Arkansas Regulation 22.205(a)(2), and
notes that such an expansion of WMI's facilities will provide convenient and additional economical
solid waste disposal for the City of Jacksonville, Pulaski County, and surrounding communities.
SECTION THREE: All resolutions or parts of resolutions in conflict herewith are hereby
repealed to the extent of said conflict.
