0519 RESOLUTION NO, 519 ( #6 - 99) A RESOLUTION AUTHORIZING THE MAYOR OF THE CITY OF JACKSONVILLE, ARKANSAS, TO AUTHORIZE AND/OR EXECUTE MODIFICATIONS AND /OR CONTRACTS WITH ARKANSAS DEPARTMENT OF ENVIRONMENTAL QUALITY ON BEHALF OF THE JACKSONVILLE WASTEWATER UTILITY; AND, FOR OTHER PURPOSES WHEREAS, the City of Jacksonville, Arkansas, by and through the Jacksonville Wastewater Utility, entered into a "Contract of Obligation" with the Arkansas Department of Pollution Control and Ecology (ADPC &E) in 1997 as authorized by ACA § 8 -6 -1603 for improvement to the City's sanitary wastewater system; WHEREAS, since that time, ADPC &E has changed its name to reflect its overall environmental concerns to Arkansas Department of Environmental Quality (ADEQ). As such, ADEQ is modifying all existing contracts of obligation with municipalities throughout Arkansas to reflect the new name of its agency. Because the Mayor is the proper person to execute such necessary documents on behalf of the Utility /City, it is necessary to approve a new resolution reflecting ADEQ's name. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT: SECTION ONE: The Mayor is hereby authorized as the Signatory Agency of the City of Jacksonville, Arkansas, to enter into and /or modify any contract of obligation with the Arkansas Department of Environmental Quality (ADEQ), formerly known as the Arkansas Department of Pollution Control and Ecology (ADPC &E). The Mayor of the City of Jacksonville is hereby granted necessary authority to approve, execute, and /or modify all necessary documents so as to accomplish the City of Jacksonville's continued participation in its Contract of Obligation with ADEQ. SECTION TWO: The Mayor is hereby authorized and directed to execute all appropriate agreements and contracts necessary to accomplish such amendments. SECTION THREE: This Resolution shall have full force and effect immediately after its passage, and any and all resolutions in conflict herewith are hereby repealed to the extent of said conflict.
