RESOLUTION NO. St 41#2 - 99)
A RESOLUTION EXPRESSING CONCERN AND OBJECTION TO THE PROPOSED CONSENT
DECREE TO BE ENTERED IN THE MATTER OF U.S. V. HERCULES, LR -C -99 -022; AND,
FOR OTHER PURPOSES.
WHEREAS, the City of Jacksonville, Arkansas, has received a copy of the proposed Consent
Decree to be lodged in the matter of U. S. v. Hercules, LR -C -99 -022. Because of particular
concerns regarding expenditures planned for the Bald Knob National Wildlife Refuge, the City of
Jacksonville objects to entry of the Consent Decree as proposed.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: It be noted in the record of the Court that the City Council of the City
of Jacksonville, Arkansas, objects to entry of the proposed Consent Decree in the matter of U. S.
v. Hercules, LR -C -99 -022. Because expenditures of rehabilitation funds are proposed to be used
in areas that in no manner were contaminated by the Vertac Plant site and its occupants, the
Jacksonville City Council wishes for the Court to omit funding proposals to areas outside of the City
of Jacksonville and /or particular sites not already affected by the hazardous waste emitted from
the Vertac Planc site. The Jacksonville City Council further recommends use of said funds in the
Holland Bottoms area, Arkansas Highway and Transportation Department property, the Reed's ,;
Bridge Area, the Bayou Meto Basin (Watershed) Area, and other public lands and areas directly
• affected by the Vertac Plant site contamination.
SECTION TWO: All resolutions or parts of resolutions in conflict herewith are hereby
