0776 q~ ORDINANCE NO. 7 7 6 (#9-85) AN ORDINANCE AMENDING RATES FOR SERVICES RENDERED BY THE WATERWORKS OF THE CITY OF JACKSONVILLE, ARKANSAS; AMENDING ORDINANCES NUMBER 541 AND 677 AND SECTION 13.16.010 OF THE MUNICIPAL CODE OF JACKSONVILLE; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT: Section 1. Ordinances Number 541 and 677 and Section 13.16.010 of the Jacksonville Municipal Code is hereby amended to read as follows: "The following monthly rates and charges which the City Council hereby finds and declares are fair, reasonable and necessary minimum rates be, and they are hereby, fixed as rates to be charged for water services to be rendered by the System. Monthly Water Rates. The water usage of each customer shall be determined each month by meter measurement and the amount to be paid by each customer shall be computed on the basis of the following schedule of rates: CONSUMPTION RATES Minimum 2,000 gallons $5.30 Next 18,000 gallons 1.85 Next 30,000 gallons 1.75 Allover 50,000 gallons 1.60 REGULAR OUTSIDE CITY RATES shall be the City rates as listed above plus an additional fifty percent (50%), with the following exceptions for special groups of customers: A. The Little Rock Air Force Base rate shall be a flat rate of $1.60 per 1,000 gallons (unless modified by contract); B. The Valentine - Dick Jeter Water Users Association, Furlow Water Users Association and the City of Cabot's rates shall be the regular City rates as listed above, plus an addi- tional twenty-five percent (25%). No more than one residential unit or one commercial or industrial establishment shall be served through one meter, except where this condition now exists or except where special conditions make it more practical to serve through one meter. Where more than one residential unit (e.g., residence, apartment, mobile home, housekeeping or other unit) or commercial or industrial establishment is served through one meter, both the minimum charge and the consumption blocks set forth in this sec- tion will be increased in proportion to the number of such units served through the one meter. Where more than one meter is required to serve a single commercial or industrial establish- ment, the meter size will be combined for the purpose of deter- mining the minimum rate. Where multiple residential units are served through one meter, the minimum charge for each unit will be based upon the residential minimum for a five-eighth-inch meter. In all such multiple unit situations, a one dollar per unit billing credit shall be granted on the basis of an assumed eighty-five percent occupancy rate." qq section 2. That the provlslons of this Ordinance are separable and if a phrase or provision shall be declared invalid, such declaration shall not affect the validity of the remainder of the Ordinance. Section 3. That all ordinances and resolutions and parts thereof in conflict herewith are hereby repealed. section 4. That it is hereby ascertained and declared that the lack of funds constitutes a hazard to the life, health and welfare of the inhabitants of the City, and that only by the passage of the foregoing rates can this situation be corrected. It is, therefore, declared that an emergency exists and this Ordinance being necessary for the immediate preservation of the public peace, health and safety shall take effect and be in force from and after its passage.
