0444 RESOLUTION NO. 444 (it2-92)
A RESOLUTION OF INTENT BY THE CITY OF JACKSONVILLE, ARKANSAS,
TO BECOME A MEMBER OF THE PULASKI COUNTY REGIONAL SOLID WASTE
MANAGEMENT DISTRICT; AND, FOR OTHER PURPOSES.
WHEREAS, Act 752 of 1991 requires that all Arkansas
counties and first class cities participate in regional solid
waste management districts and that governing boards of all
regional solid waste management districts be comprised of one
representative from each first class city in the district and
one representative from each county in the district; and,
WHEREAS, Act 752 of 1991 also establishes the powers,
duties, and responsibilities of the regional solid waste
management districts and gives Arkansas counties with over
50,000 population the authority to form single county
regional solid waste management districts; and,
WHEREAS, Arkansas Department of Pollution Control and
Ecology (ADPC &E) has issued "Procedures for the Creation of
Regional Solid Waste Management Districts" under Act 752 of
1991, of which the City of Jacksonville has been provided a
copy; and,
WHEREAS, on February 6, 1992, the City Council of the
City of Jacksonville heard a presentation of the provisions
of Act 752 of 1991 and received a written proposal summari-
zing the Act. A copy of said proposal is attached hereto,
made a part hereof, and the City of Jacksonville believes its
interests will best be served by a Pulaski County Regional
Solid Waste Management District.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: The City Council is aware of the duties,
responsibilities, and powers conferred by Act 752 of 1991
and, acting in accordance with ADPC &E "Procedures for the
Creation of Regional Solid Waste Management Districts ",
expresses its intent to become a member of the Pulaski County
Regional Solid Waste Management District. The City Council
requests that ADPC &E designate Pulaski County as a regional
solid waste management district.
SECTION TWO: Any Resolutions or parts of Resolutions in
conflict herewith are hereby repealed to the extent of the
conflict.
SECTION THREE: This Resolution shall be in effect from
and after its date of passage.
