13 APR 08 CITY OF JACKSONVILLE, ARKANSAS REGULAR PLANNING COMMISSION MEETING APRIL 8, 2013 7:00 P.M. – 7:23 P.M. OPENING REMARKS: The Planning Commission of the City of Jacksonville, Arkansas met in regular session on February 11, 2013. Chairman Keaton opened the meeting at approximately 7:00 p.m. expressing appreciation to those in attendance. ROLL CALL: Commissioners Scott Scholl, Jim Moore, Avis Twitty, Joe Cummings, Jr., Joe Ott, and Alderman Bill Howard answered ROLL CALL. Chairman Keaton also answered roll call and declared a quorum. PRESENT (5), ABSENT (1). Others present for the meeting were City Attorney Bamburg, City Engineer Jay Whisker, interested citizens, petitioners, and press. CORRECTION AND/OR APPROVAL OF MINUTES: Alderman Howard moved, seconded by Commissioner Cummings to approve the minutes of the regularly scheduled Planning Commission meeting of 02 February 2013 as presented. MOTION CARRIED. PUBLIC HEARING(S): REQUEST TO APPROVE PLAT(S): FINAL PLAT: Jaxon Terrace PH 9 Discussion was suspended pending the arrival of Mr. Tommy Bond of Bond Engineering Mr. Bond arrived at approximately 7:10 p.m. Mr. Tommy Bond of Bond Engineering apologized for being tardy. He related that the developer has posted a letter of credit in the amount of $96,000.00. He stated that when it stops raining they would be able to complete the Subdivision phase. He related that the curb and gutter has been completed and he believes the sub-grade has been finished. He stated that rain is expected again before they will be able to get the gravel in and the asphalt down. He added that the Water and Sewer Departments have signed off on the utilities. He asked for approval with the letter of credit, so they could proceed with this phase of the Subdivision. City Engineer Whisker stated that the letter of credit is on file and sewer has been approved, but added that he there is one small item outstanding for the Water Department. He related that the developer is ready to begin selling lots, so he has posted the letter of credit to cover any unfinished improvements. He stated that the developer could sell lots immediately with the final plat of this phase. He went on to say that the problem would be access to the lots without a completed street. He explained that the City would not issue building permits until the street is completed and accepted by the City. He pointed out that being able to sell lots even without the street being completed would help the developer recoup development expenses. Mr. Bond pointed out that the developer has sold all available lots in the previous phase, saying that builders do not like to stop the momentum once they start building in an area. Alderman Howard moved, seconded by Commissioner to approve the Final Plat for Jaxon Terrace PH 9 with a letter of credit. MOTION CARRIED. Mr. Bond stated that he did not feel that City Council would approve the final plat until the streets were accepted. City Engineer Whisker pointed out that the streets have been bonded for so it would not matter as long as there is a letter of credit on file. Mr. Bond noted that the developer would like to file the plat as soon as possible so he could begin to sell the lots. b. PRELIMINARY PLAT Crooked Creek PH III Mr. Bond recalled that other areas of this Subdivision was submitted to the Planning Commission more than five years ago. He then explained that this phase is a small piece of property on the west end of General Samuels and Harris Road. He stated that the availability of sewer stopped the progress of this Subdivision almost 10 years ago was the availability of sewer, explaining that the sewer is available to this end of the Subdivision. He noted that the sewer would go under General Samuels to this phase. He also noted that a 10” waterline would be constructed going down General Samuels. He stated that the sewer is a gravity extension of the existing sewer line, which was planned for 15 years ago. He surmised that these homes would be comparable to the houses that were built in phase I, somewhere between 1400 and 1600 square feet. City Engineer Whisker stated that the road would be 36’ back to curb, back to curb. He related that lots 173 through 162 face General Samuels, explaining that to improve General Samuels on the north side of the road to 18’ back to curb. He stated that it is equal to two 9’ lanes. He then clarified that the City will most likely participate in adding an additional 4’ of asphalt so that there are two lanes from the new road of Burnsides Drive all the way to Harris Road along General Samuels so there will be two westbound lanes. Discussion ensued regarding a change from shared driveways; Mr. Bond noted that there is resistance from the property owners. He then added that he did not feel it would be an issue with the extra lane. City Engineer Whisker concurred, saying that Harris Road has quite a bit of traffic and none of those driveways are shared. He then clarified that the fenced in area in the northwest part of the parcel is a gas regulator. Mr. Bond added that there a large gas line easement in the vicinity of the property that crosses the road and goes to the corner of this property. City Engineer Whisker pointed out that if a round-a-bout is constructed part of that parcel would be included in the development of the round-a-bout. Mr. Bond then concurred with Chairman Keaton that there would be sidewalks on General Samuels. City Engineer Whisker recalled that the City was recently awarded a grant regarding Safe Routes to Schools, pointing out that Harris Road is two-lanes northbound with the northbound lane ending at Tolleson Elementary School, adding that there is a sidewalk from North Pulaski High School down to General Samuels. He continued saying that this sidewalk would attach leaving only a small gap that would have been phase II of Crooked Creek. Mr. Bond commented that sooner or later phase II will be built when sewer is available as it comes up from the Forest Oak area. City Engineer Whisker explained that the entrance to Crooked Creek runs north almost to the Air Base line and then turns east and west, noting that Burnside Drive will run north and cross the creek giving the Subdivision two entrances, making a loop through the Subdivision. He then noted that the land to the north belong to Tolleson Elementary. Mr. Bond stated the developer has made several attempts to purchase a strip of land from Pulaski County so that another street could be developed so that none of the lots would face General Samuels, but Pulaski County were not willing to sell any of the property. Commissioner Ott moved, seconded by Commissioner Cummings to approve the preliminary plat of Crooked Creek PH 3. MOTION CARRIED. BUILDING PERMIT(S): SITE PLAN Kroger’s Fuel Center City Engineer Whisker noted that this item is being removed, saying that it did not successfully pass the Board of Adjustment parking variance request.
