0880 / ft, 2- ORDINANCE NO. 8 8 0 (#4-88) AN ORDINANCE PROHIBITING THE MAKING OF FALSE ALARMS AND FALSE REPORTS BY TELEPHONE OR IN PERSON TO THE JACKSONVILLE POLICE AND/OR FIRE DEPARTMENTS; PENALTY FOR VIOLATION; AND FOR OTHER PURPOSES. WHEREAS, the Jacksonville Police and Fire Department employees are frequently required to spend time at taxpayers' expense on false reports and alarms; and, WHEREAS, in order to deter persons from making false reports and false alarms, it is necessary to enact this Ordinance prohibiting same; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT: SECTION ONE: It shall be unlawful for any person to com- municate a false alarm or false police report to the Jacksonville Police Department and/or the Jacksonville Fire Department, knowing that the alarm or report is false or baseless. SECTION TWO: "Communicate" as used in this Ordinance means by telephone or in person. SECTION THREE: A person who violates this Ordinance shall be guilty of a misdemeanor and shall be fined a sum not less than $100.00 nor more than $250.00, plus court costs and restitution to the City, for the costs of manpower time to respond to or investi- gate said false alarm or false report. The offense may also be punishable by up to ten (10) days in the City jail. SECTION FOUR: All Ordinances and parts of Ordinances in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict. SECTION FIVE: This Ordinance shall take effect and be in force thirty (30) days from and after its passage. APPROVED AND ADOPTED THIS 1xth DAY OF FEBRUARY, 1988.
