ORDINANCE NO.

AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE PURPOSE OF
PROVIDING FOOD SERVICE FOR THE PRISONERS IN THE JACKSONVILLE CITY
JAIL; AND FOR OTHER PURPOSES.
WHEREAS, it is necessary for the City to provide meals for
the inmates of the Jacksonville City Jail, and, because the City
does not have a cafeteria or kitchen facility in which to prepare
the meals, meals from local restaurants have been used to feed
the inmates; and
WHEREAS, the City has secured five (5) estimates and only
one (1) estimate was for delivered meals; and,
WHEREAS, Arby's Restaurant is capable of providing meals
for the Jacksonville City Jail inmates that meet all recommended
daily allowances for adults, and can be provided to the City at a
price of only $.01 more per meal than what the lowest estimate of
the local restaurants can provide; and,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION 1: Competitive bidding for the purpose of pro-
viding meals for the inmates of the Jacksonville City Jail would
be costly and non-productive, making said competitive bidding
unfeasible and impractical.
SECTION 2: Competitive bidding is hereby waived, pursuant
to Arkansas Code of 1987 Annotated S14-58.383, for the purpose of
providing meals for the inmates of the Jacksonville City Jail and
authorization is given to the City Purchasing Department to enter
into a contract with Arby's Restaurant to provide said meals.
SECTION 3: Any Ordinance in conflict herewith is specifi-
cally repealed to the extent of such conflict.
SECTION 4: This Ordinance shall take effect and be
in force from and after its passage.
