ORDINANCE NO. 8 6 5 (#17-87)
AN ORDINANCE AMENDING ORDINANCE NUMBERS 727, 759, 805, AND 845,
FIXING AND IMPOSING THE AGGREGATE AMOUNT OF FEES, CHARGES AND
SPECIAL TAXES TO BE PAID THE CITY OF JACKSONVILLE, ARKANSAS, BY
THE GENERAL TELEPHONE COMPANY OF THE SOUTHWEST AND THE METHOD OF
PAYMENT THEREOF; DECLARING AN EMERGENCY AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
JACKSONVILLE, ARKANSAS, THAT:
SECTION 1. It is hereby declared that Ordinance Numbers
727, 759, 805, and 845 should be amended as set forth below.
SECTION 2. Section B of said Ordinance Number 727 and
Section 2 of said Ordinance Numbers 759, 805, and 845 are hereby
amended to read as follows:
"The sale, furnishing, transmission and distribution of the
telephone service by General Telephone Company within the
City is hereby declared to be a special privilege and for
such privilege the General Telephone Company shall pay to
the City an assessment amounting to:
For the first eight (8) months of 1987, the General
Telephone Company of the Southwest shall pay in monthly
installments the total sum of One Hundred Thousand and
00/100 Dollars ($100,000.00) (based on an annual assess-
ment of $150,000.00). For the last four (4) months of
1987, beginning September, 1987, the General Telephone
Company of the Southwest shall pay in monthly installments
the total sum of One Hundred Thirty-three Thousand, Three
Hundred Thirty-three and 33/100 Dollars ($133,333.33)
(based on an annual assessment of $400,000.00).
Payments shall continue in succeeding years unless sooner modified."
In all other respects, said Ordinances shall remain unchanged.
SECTION 3. All Ordinances and parts of Ordinances in
conflict with the provisions of this Ordinance are hereby
repealed.
SECTION 4. It is hereby found by the Jacksonville City
Council that there is an urgent need for additional revenues for
the City. Therefore, an emergency is declared to exist, and this
Ordinance being necessary for the preservation and advancement of
the public peace, health, and safety shall be in full force and
effect from and after its passage.
