ORDINANCE NO. 855 (#7-87)
AN ORDINANCE AMENDING ORDINANCE NOS. 542 and 647, SPECIFICALLY
CODIFIED AS SECTIONS 3.08.020, 3.08.030 AND 3.08.035 OF THE
JACKSONVILLE MUNICIPAL CODE, RAISING THE PURCHASING LIMITATION ON
EXPENDITURES WITHOUT COMPETITIVE BIDDING; DECLARING AN EMERGENCY;
AND FOR OTHER PURPOSES.
WHEREAS, The present Ordinance concerning purchasing limi-
tation on expenditures without competitive bidding are currently
limited to those expenditures at state bid prices of less than
Two Thousand Dollars ($2000.00); and
WHEREAS, The Arkansas State Legislature enacted a state
statute allowing Arkansas cities to increase the limitation to
expenditures without competitive bidding at state bid prices, of
less than Five Thousand Dollars ($5000.00);
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION 1: Part of Ordinance Nos. 542 and 647 of the City
of Jacksonville, specifically that part codified as Sections
3.08.020, 3.08.030, and 3.08.035 of the Jacksonville Municipal
Code, should be and hereby are amended to read as follows:
"3.08.020. Expenditure above Five Hundred
Dollars but below Five Thousand Dollars - Bids.
All purchases for the City of supplies, apparatus, equip-
ment purposes where the expenditure therefore is in
excess of Five Hundred Dollars ($500.00) but less than
Five Thousand Dollars ($5000.00) shall be made by the
Mayor, or his duly authorized representative, after the
securing of quotation bids; provided, however, that
purchases of less than Five Thousand Dollars ($5000.00),
at state bids prices, shall be exempt from the provisions
of this chapter."
"3.08.030. Expenditure exceeding Five Thousand Dollars
($5000.00) - Competitive bids by legal advertisement.
Where the amount of expenditure for any purchase or
contract exceeds the sum of Five Thousand Dollars
($5000.00), the Mayor, or his duly authorized represen-
tative, shall invite competitive bids thereon by legal
advertisement in any local newspaper. Bids received pur-
suant to the advertisement shall be opened and read on the
date set for receiving the bids, in the presence of the
Mayor or his duly authorized representative. The contract
shall be awarded to the lowest responsible bidder; pro-
vided, however, that the Mayor or his duly authorized
representative may reject any and all bids received."
"3.08.035. Purchase over Five Thousand Dollars ($5000.00).
On all purchases of supplies, equipment or service of more
than Five Thousand Dollars ($5000.00), advertisement for
bids must be taken pursuant to Ark. Stat. Ann. S19-4425
unless the City Council shall by ordinance waive com-
petitive bidding in exceptional situations where such pro-
cedure is deemed unfeasible or practical."

SECTION 2: Whereas, the purpose of this amendment is to
eliminate the confusion surrounding the existing ordinances, it
is deemed an emergency and shall take effect immediately upon
passage in order to protect the public health, safety and
welfare.
SECTION 3: That all ordinances or parts of ordinances in
conflict herewith are hereby repealed to the extent of such
conflict.
