825 (#16-86)
AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE PERFORMANCE OF
DRAGLINE WORK IN THE CITY OF JACKSONVILLE, ARKANSAS, ON OR AROUND
DUPREE PARK AND THE GRAHAM ROAD LANDFILL; AND FOR OTHER PURPOSES.
WHEREAS, it is necessary for the City Engineer's Department
of Jacksonville, Arkansas to have small amounts of dragline
digging work done on or around Dupree Park and the Graham Road
Landfill in order that other work may be performed in those
respective areas.
WHEREAS, the work required to be done is a small amount
when compared to other dragline construction performed and
Taylor Construction of Lepanto, Arkansas, has been the only
dragline construction company to bid on the last two dragline
projects performed in the City of Jacksonville, Arkansas; and
WHEREAS, the performance of Taylor Construction on the pre-
vious dragline constructions for the City has been excellent,
providing excellent service at a very reasonable price;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION 1: Competitive bidding for the performance of
dragline work on or around Dupree Park and the Graham Road
Landfill in the City of Jacksonville, Arkansas, would be costly
and nonproductive, making said competitive bidding unfeasible and
impractical.
SECTION 2: Competitive bidding is hereby waived pursuant
to Ark. Stat. Ann. S19-4425, for the performance of dragline
construction in or around Dupree Park and the Graham Road
Landfill for the City Engineer's Department and authorization is
given for said construction to be performed by Taylor
Construction, Lepanto, Arkansas.
SECTION 3: Any ordinance in conflict herewith is specifi-
cally repealed to the extent of such conflict.
SECTION 4: This Ordinance shall take effect and be in
force from and after its passage.
