AN ORDINANCE AMENDING ORDINANCE NO. 789 TO PROVIDE FOR THE
ISSUANCE OF PERMITS BY THE JACKSONVILLE FIRE DEPARTMENT TO ALLOW
FOR RESTRICTED BURNING OF NON-TOXIC/NON-HAZARDOUS WASTES WITHIN
THE CITY LIMITS OF THE CITY OF JACKSONVILLE, ARKANSAS: TO DECLARE
AN EMERGENCY: AND FOR OTHER PURPOSES.
WHEREAS, the Jacksonville City Council passed Ordinance No.
789 which prohibits the burning of any solid wastes within the
City limits of Jacksonville, Arkansas because of their concern
for the health and safety of the citizens of Jacksonville.
WHEREAS, since the passage of Ordinance 789 many citizens
and businesses in the City have expressed concern over the effect
the prohibition has had on their everyday household and business
activities.
WHEREAS, the City Council has determined that the burning
of non-toxic/non-hazardous wastes within the City limits of Jacksonville,
Arkansas, while monitored by the Jacksonville Fire Department,
would properly provide for the health and safety of the citizens
of Jacksonville and allow the citizens and businesses to complete
their daily activities.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS THAT:
Section 1: Ordinance No. 789 is hereby amended to provide
for the issuance of permits by the Jacksonville Fire Department
to allow for restricted burning of non-toxic/non-hazardous wastes
within the City limits of the City of Jacksonville, Arkansas.
Section 2: Any citizen or business wishing to burn non-
toxic/non-hazardous wastes within the City limits shall apply to the
Jacksonville Fire Department for a permit to burn said wastes
prior to any burning.
Section 3: The Jacksonville Fire Department shall be
directed to monitor any and all burning within the City limits
and make certain that the citizens and businesses adhere to
strict compliance of the permit issued for their respective
burning.
SECTION 4: For purposes of this Ordinance, non-toxic/non-hazardous
wastes shall be defined as naIl wastes in solid or semisolid form
that contains no substance or that will not emit any substance while
being burned, which is included in the EPA National Register
and/or OSHA regulations as hazardous or toxic substances.
SECTION 5: It is hereby ascertained and declared that the
prohibition of burning of any solid wastes within the City limits
of the City of Jacksonville constitutes an immediate hazard to
the public health and safety and that by passage of this
Ordinance the situation can be alleviated.
SECTION 6: Any ordinance or part of any ordinance in
conflict herewith is hereby repealed to the extent of such
conflict.
