ORDINANCE NO. 814 (#5-86)
AN ORDINANCE SUBMITTING THE QUESTION OF LEVYING AN ADDITIONAL
ANNUAL TAX OF ONE-HALF MILL UPON THE ASSESSED VALUE OF THE REAL
AND PERSONAL PROPERTY WITHIN THE CITY OF JACKSONVILLE FOR THE
PURPOSE OF THE POLICEMEN'S PENSION AND RELIEF FUND TO THE
QUALIFIED VOTERS OF THE CITY AT THE SPECIAL SCHOOL BOARD ELECTION
ON MARCH 11, 1986; AND FOR OTHER PURPOSES.
WHEREAS, the City of Jacksonville, Arkansas, is a city of
the first class and is authorized by state statute to levy an
annual tax of one mill upon the assessed value of all real and
personal property within such city for the purpose of providing
funding for the policemen's retirement and pension fund; and
WHEREAS, at the present time an annual tax of one-half mill
is being levied and such assessment is not sufficient to provide
for an actuarily sound and judiciously administered pension fund
for securing and retaining the services of a most faithful and
efficient class of individuals connected with the police depart-
ment a municipal service in which every property owner and resi-
dent of this City is vitally interested; and
WHEREAS, Jacksonville is one of the few municipalities
which is not presently levying a one mill tax to provide for the
benefit of the policemen's pension fund; and
WHEREAS, it is the opinion of the City Council of the City
of Jacksonville, that it is for the best interest of the City of
Jacksonville, Arkansas, that the police department retirement and
pension fund be actuarily sound and judiciously administered.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS THAT:
SECTION 1: There shall be submitted to the qualified elec-
tors of the City of Jacksonville, Arkansas, at the special school
board election to be held on March 11, 1986, the question of the
levy of an additional annual tax of one-half mill upon the
assessed value of all real and personal property within the City
of Jacksonville for the purpose of providing funding for the
policemen's retirement and pension fund.
SECTION 2: The ballot title shall appear as follows:
"The Question of Levying an (additional) annual tax
of one-half mill upon the Assessed Value of the Real
and Personal Property within the City and for the Pur-
pose of the POLICEMEN'S PENSION AND RELIEF FUND."
SECTION 3: The question shall be placed on the ballot in
substantially the following form:
"Vote on measure by placing an 'X' in the square
beside the measure either for or against:
"FOR LEVYING AN ADDITIONAL ANNUAL TAX OF
ONE-HALF MILL FOR THE POLICEMEN'S PENSION AND
RELIEF FUND ,NOT TO EXCEED A TOTAL OF ONE MILL. .
"AGAINST LEVYING AN ADDITIONAL ANNUAL TAX
OF ONE-HALF MILL FOR THE POLICEMEN'S PENSION
AND RELIEF FUND" NOT TO EXCEED A TOTAL OF ONE MILL. .

SECTION 4: The election shall be held and conducted and the
vote canvassed and the results declared under the law and in the
manner now provided for municipal elections, so far as the same
is applicable, and the Clerk of the City is hereby authorized and
directed to give notice of such election by an advertisement
published not less than ten (10) days prior to the election in a
newspaper published in the City, and having a bona fide cir-
culation therein, the last publication to be not less than ten
days prior to the date of the election, and only qualified voters
of the City shall have the right to vote at said election on said
question.
SECTION 5: The results of the election shall be proclaimed
by the Mayor and his Proclamation shall be published one time in
a newspaper published in the City and having a bona fide cir-
culation therein, which Proclamation shall advise that the results
as proclaimed shall be conclusive unless attacked in the courts
within thirty (30) days after the date of such Proclamation.
SECTION 6: A copy of this Ordinance shall be given to the
Pulaski County Board of Election Commissioners so that the
necessary election officials and supplies may be provided.
SECTION 7: This Ordinance shall take effect on and after
the date of its adoption, approval and passage.
