AN ORDINANCE AMMENDING ORDINANCE NO. 6041 SPECIFICALLY CODIFIED
AS JACKSONVILLE M'UNICIPAL CODE (:tIApfi:rER 13 $ 24, I~EGUI.>>ArrING THE
JACKSONVILLE SEWER SYSTEM I JACKSON'VILLE I ,ARKANSAS; DECLARING AN
EMERGENCY'; AN'D FOR OTH'ER P(IRPOSES.
WHEREAS, the Jacksonville Sewer Commission, under authority
granted by the City council of the City of Jacksonville,
Arkansas, operates and maintains a public sanitary sewer system
for the protection of the health and welfare of the inhabitants
of Jacksonville, Arkansas, and,
WHEREAS, the introduction of ground and surface water to the
public sanitary sewer system increases cost of sewage treatment
and increases the potential of over flows within the public
sanitary sewer system, thereby endangering the health and welfare
of the citizens of the City of Jacksonville, Arkansas, and,
WHEREAS, it has been determined that a substantial amount of
ground and surface water is introduced into the public sanitary
sewer system through privately owned building drains and sewers;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
JACKSONVILLE, ARKANSAS, THAT:
SECTION 1. The Municipal Code of Jacksonville, Arkansas,
section 13.24.04, is hereby ammended by adding Paragraph
13.24.04(12), which reads as follows:
CHAPTER 13.24
SEWER SYSTEM
13.24.04 Building Sewer and Connections
(12) The owners of land shall be required to maintain their
building drains and sewers in their entirety (including the point
of connection to the public sewer) in a water tight condition so
as to eliminate the introduction of surface or ground water to
the sewer system. If it is determined by the Manager that a
building drain or sewer has not been maintained in a water tight
condition, the owner shall be notified by certified mail that, at
the owners expense, repairs must be made within a reasonable time
(not to exceed 90 days) in order to restore the building drain or
sewer to a water tight condition. If satisfactory repairs are
not made by the owner and inspected by duly authorized
Jacksonville Wastewater utility personnel within the specified
time, the Jacksonville Sewer Commission may require that water
service be discontinued to that building or property until
satisfactory repairs are made and inspected, and the Commission
shall have the authority to make such rules and regulations as
may be necessary to carry out the purpose of this section.
section 2. All Ordinances or parts thereof in conflict
herewith are hereby repealed to the extent of such conflict.
Invalidity of any part of this Ordinance shall not invalidate any
other part thereof.
section 3. It is ascertained and declared that the
introduction of ground and surface waters to the public sanitary
sewer system through privately owned building drains and sewers
endangers the life, health, and property of the inhabitants of
the City and that, in order to protect its inhabitants, the
provisions of this Ordinance must be implemented immediately. It
is, therefore, declared that an emergency exists, that this
Ordinance is necessary for the i~ediate preservation of the
puplic peace, health., and safety, a,nd that this OrdiI1ance shall
take effect and be in force from and after its passage.
