ORDINANCE NO. 9 3 1 (1111-90)
AN ORDINANCE AMENDING ORDINANCE NO. 835, REQUIRING A SECURITY
DEPOSIT FOR ANIMALS ADOPTED FROM THE ANIMAL SHELTER TO INSURE
VACCINATION AND STERILIZATION, DECLARING AN EMERGENCY, AND FOR
OTHER PURPOSES.
WHEREAS, there is currently a requirement that any animal
adopted from a public shelter be vaccinated against rabies and
sterilized within twenty (20) days of the adoption date, and
WHEREAS, the Jacksonville Animal Shelter has had difficulty
in enforcing said requirement.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: Ordinance No. 835, codified as 6.04.100 of the
Jacksonville Municipal Code, should be and hereby is amended to
read as follows:
The Animal Control authority may convey ownership
or permit adoption of any animal which has become the
property of the Animal Control authority to a respon-
sible person, subject to such conditions as may be
prescribed by the Animal Control authority, including,
without limitation, the following: (a) payment of a
Five Dollar ($5.00) adoption fee and receipt by the
Animal Control authority of a statement by the adopting
party that the animal will be licensed and vaccinated
within a five (5) day period; (b) evidence satisfactory
to the Animal Control authority that the animal has, or
will be, examined by a veterinarian and vaccinations
against rabies or other disease administered; and (c)
posting of a Twenty-Five Dollar ($25.00) security depo-
sit to insure the animal is vaccinated and sterilized
within twenty (20) days of adoption. This deposit is
fully refundable provided the adopting party presents
to the Animal Control authority documented proof of
vaccination and sterilization within twenty (20) days
from the adoption date. If said proof is not received
said security deposit is forfeited and goes into the
City general funds.
The Animal Control authority may, upon good cause
shown by the adopting party, grant an extension of time
not to exceed thirty (30) days. This statement shall
be binding and failure to comply with its terms consti-
tutes a violation of this Ordinance. In that event,
the animal shall be returned to the Animal Control
authority upon written demand by the authority, with
ownership of said animal reverting to the Animal
Control authority.
SECTION THREE: It being necessary to protect the public
health, safety, and welfare, it is hereby declared that an
emergency exists and this Ordinance shall be in force and take
effect immediately upon its passage.
SECTION FOUR: That all Ordinances or parts of Ordinances
in conflict herewith are hereby repealed to the extent of any
such conflict.
