ORDINANCE NO. 927 (#7 - 90)
AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE PURPOSE OF
PURCHASING A USED VEHICLE TO BE UTILIZED BY CITY DEPARTMEN~S AS A
COMMAND POST / HAZ/MAT UNIT; DECLARING AN EMERGENCY; AND, FOR
OTHER PURPOSES.
WHEREAS, it is necessary for the City of Jacksonville to
have adequate equipment to properly respond to emergencies in the
City, for there is no adequate equipment to provide the services
needed in a Command post / HAZ/MAT unit in response to local
emergency situations: and,
WHEREAS, purchase of a new vehicle is beyond the monetary
budget of the City; however, purchase of a quality used vehicle
from the private sector market with a maximum expenditure of Ten
Thousand Dollars ($10,000.00) would provide good value and equip-
ment within the means of the City's budget: and,
WHEREAS, this vehicle can be utilized by a number of City
departments to allow adequate equipment for a self-contained ana
mobile Command post for local officials at an emergency incident
and/or disaster location within our City limits. In addition,
this vehicle can serve as a HAZ/MAT unit for storage and treatment
for those involved in response to emergency incidents involving
any hazardous materials: and,
WHEREAS, because time is of the essence in order to secure
the purchase of this used vehicle and to provide the most effi-
cient and effective emergency response service to the citizens of
Jacksonville.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COtJNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: Competitive binding for the purpose of
purchasing a used-vehicle to be utilized by City departments as a
Command post/HAZ/MAT unit would be costly and non-productive,
making said competitive bidding unfeasible and impractical.
SECTION TWO: Competitive bidding is hereby waived, pursuant
to Arkansas Code of 1987 Annotated ~14-58-~, for the purpose of
purchasing a used vehicle, whether it be a motor home or travel
trailer, from the used vehicle market in this area and auth-
orization is given to the Jacksonville Fire Department to super-
vise the purchase such a unit for the best value available, with a
maximum expenditure of Ten Thousand Dollars (S10,000.00) given for
the purchase and preparatory work (if necessary) in order for said
vehicle to meet the City's needs and standards. Said purchase
shall be made as quickly as possible, but value and condition
shall be foremost in consideration of this purchase. If an ade-
quate vehicle is not found within six (6) months from the date of
passage of this Ordinance, then this matter shall be brought back
before this Council for review and further determination.
SECTION THREE: It being necessary to protect the public
health, safety, and welfare by providing adequate emergency
response service, it is hereby declared that an emergency exists
and this Ordinance shall be in force and take effect immediately
upon its passage.
SECTION FOUR: All Ordinances or parts of Ordinances in
conflict herewith are specifically repealed to the extent of such
conflict.
