AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE PURPOSE OF
PURCHASING A 1979 PIERCE (1000) GPM PUMPER TRUCK FOR THE CITY
OF JACKSONVILLE, ARKANSAS; DECLARING AN EMERGENCY; AND FOR
OTHER PURPOSES.
WHEREAS, it is necessary for the Fire Department of the City
of Jacksonville to purchase a pumper truck to adequately provide
fire protection for the citizens of the City of Jacksonville; and,
WHEREAS, purchase of a new pumper truck would be beyond the
monetary budget of the City's Fire Department and Nottingham
Volunteer Fire Company can provide a used pumper truck of good
value at $55,000.00, substantially less expensive than a new one;
and,
WHEREAS, additional repairs, replacements, and painting,
at an estimated cost of $7,500.00, will be required to place the
pumper into service, and use of the Arkansas state prison System
will provide the repairs and painting at a substantial savings to
the City; and,
WHEREAS, time is of the essence in order to secure the
purchase of this vehicle and to provide continuous fire protection;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: Competitive bidding for the purpose of
purchasing a 1979-pierce 1000 GMP pierce pumper Truck would be
costly and non-productive, making said competitive bidding
unfeasible and impractical.

SECTION TWO: Competitive bidding is hereby~waived, pursuant
to Ar kansas Code of 1987 Annotated ~ 14- 5 8~3.a-'3", for the purpose of
purchasing a 1979 pierce (1000 GMP) pierce pumper Truck and auth-
orization is given to the Jacksonville Fire Department to purchase
said truck from Nottingham Volunteer Fire Company, 3420 Street
Road, Bensalem, pennsylvania 19020, at a price of Fifty-five
Thousand and 00/100 Dollars ($55,000.00).
SECTION THREE: Competitive bidding is also waived for
additio~al-i~p~irs, replacements, and painting, at an approximate
cost of $7,500.00. These repairs, replacements, and painting are
hereby authorized and approval is granted for services to be rend-
ered by the Arkansas state Prison System.
SECTION FOUR: It being necessary to protect the public
health,--safety-', a-nd welfare by providing adequate fire protection,
it is hereby declared that an emergency exists and this Ordinance
shall be in force and take effect immediately upon its passage.
SECTION FIVE: All Ordinances or parts of Ordinances in
conflic-f her'ewiti1" are specifically repealed to the extent of such
conflict.
