A RESOLUTIONIN SUPPORT OFANDAUTHORIZING EXECUTION OF
A PERMANENT UTILITY EASEMENT FROM THE CITY OF
JACKSONVILLEFOR CERTAINREAL PROPERTYDESCRIBEDHEREIN
(GENERAL DESCRIPTION; #1 MUNICIPAL DRIVE, JACKSONVILLE,
ARKANSAS); AND, FOR OTHER PURPOSES,
WHEREAS, the real property described herein has an existing utility easement
granted in favor of the local telephone company, CenturyLink; and,
WHEREAS, because said utilities are being upgraded, moved, and modified for
upgraded services and because of the 67/167 Highway expansion project, the City Council
must act to authorize transfer of a different utility right of way to CenturyLink. To
effectively make said transfer, the City Council must authorize Mayor Fletcher and City
Clerk Davitt to transfer such a real estate interest on behalf of the City.
NOW, THEREFORE, BE ITRESOLVEDBYTHE CITYCOUNCILOFTHE CITY
OF JACKSONVILLE, ARKANSAS, THAT,-
SECTION ONE; The City of Jacksonville, Arkansas, should authorize use
of the real property described below to the CenturyLink. The City Council recognizes and
agrees that doing so is necessary because of the need for upgraded services and utility
relocation due to the 67/167 Highway Expansion Project.
The Council hereby authorizes Mayor Fletcher and City Clerk Davitt to execute and
complete a Permanent Utility Easement approved by the City Attorney to grant
authorization of use and location of CenturyLink equipment upon the following described
property in Pulaski County, Arkansas:
Part of the Southeast Quarter of Section 24, T -3-N, R -11-W, City of Jacksonville, Pulaski
County, Arkansas being more particularly described as follows:
Commencing at the Southeast Corner of Section 24, T -3-N, R -11-W; Thence North,
153.70 Feet: Thence West 1,300.26 Feet; Thence NO2* 26"E, 20.10 Feet to the point of
beginning; Thence continuing N0Z4426"E, 30.00 Feet; Thence S811824"E, 50.00 Feet;
Thence S0Z44'26"W, 30.00 Feet; Thence N8-10824", 50.00 Feet to the point of beginning,
containing 1,500.00 square feet, more or less.

SECTION TWO: The City Council recognizes and understands that no
monetary amount will be exchanged between the parties to provide for this utility
relocation.
SECTION THREE .• Any and all other Resolutions in conflict herewith are
hereby repealed to the extent of said conflict. This Resolution shall be in effect from and
after its date of passage.
