RESOLUTION NO, 707 (#02 - 2014)
A RESOLUTION CONFIRMING IMPLEMENTATION OF A PASS THROUGH
CHARGE UNDER JMC § 13,16.016 FROM LONOKE-WHITE PUBLIC WATER
AUTHORITY TO JA CKSON VILL E WA TER WORKS RATEPA VERS FOR PA YMENT OF
A PASS THROUGH CHARGE FROM LONOKE-WHITE; AND, FOR OTHER
PURPOSES,
WHEREAS, because of the second phase of a Pass Through Charge (PTC) assessed to
Jacksonville Water Works (JWW) by Lonoke-White Public Water Authority (Lonoke-White) for an
increase to public water rates for customers of Jacksonville Water Works, JWW is implementing
the PTC for JWW ratepayers as of March 1, 2014; and,
WHEREAS, with authority granted through JMC § 13.16.016, Jacksonville Water
Commission authorized implementation of the 2014 Pass Through Charge from Lonoke-White in
its February 26, 2014 meeting to JWW ratepayers. The Jacksonville Water Commission noted
implementation of the 2009 phase of the Two (2) part PTC and, in an effort to make the public
more aware of the PTC, the Water Commission has requested that the City Council also
acknowledge the 2014 PTC through passage of this Resolution.
NOW, THEREFORE, BE IT RESOL VED BY THE CITY COUNCIL OF THE CITY OF
JACKSONVILLE, ARKANSAS, THAT,-
SECTION ONE: Pursuant to authority granted under JMC § 13.16.016 and per
the Notice received from Lonoke White Public Water Authority regarding the remaining phase of a
Pass Through Charge of Two and 50/100 Dollars ($ 2.50) per connection, said amount will be
collected from all JWW ratepayers to cover JWW's share of the 2014 phase of the Pass Through
Charge from Lonoke-White. Said Pass Through Charge will be implemented and collected from
JWW ratepayers beginning March 1, 2014, until further determined, with initial payment due
Lonoke-White as of April 2014. Per the terms of said Code provision, regardless of the above
numbers, only that exact charge assessed by Lonoke-White will be assessed against and passed
through to JWW ratepayers, as approved by the Water Commission and this City Council in
compliance with JMC § 13.16.016.
SECTION TWO; Any and all other Resolutions in conflict herewith are hereby
repealed to the extent of said conflict.
SECTION THREE: This Resolution shall be in force and effect from and after
its date of passage.
