AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE PURCHASE
OF CITIZEN EMERGENCY NOTIFICATION SYSTEM SERVICES; FOR
APPROPRIATE TRAININGANDACCESSFOR KEYCITYREPRESENTATIVES;
DECLARING AN EMERGENCY; AND, FOR OTHER PURPOSES,
WHEREAS, after several years of use of the CodeRED emergency notification
system, the City Council realizes the importance of immediate and efficient
distribution accurate information about weather and other related emergency
conditions to its citizens. For citizens' safety, Jacksonville has learned that such
services provided by a sole source with proper means, equipment, and technology
provides rapid, immediate, and accurate distribution of emergency information for
Jacksonville citizens who register for such notifications; and,
WHEREAS, said services, related equipment, and the necessary training for
such have been provided at a competitive price through use of the CodeRED system
from Emergency Communications Network, Inc. (ECN) of Ormond Beach, Florida.
ECN is the sole and exclusive source for said warning service and has agreed to
furnish such service, the related equipment, and appropriate training at a reduced
cost over the next Five (5) years. As such, the City recommends waiver of
competitive bidding and request that it be allowed to contract with ECN for said
services and system for its citizens, the necessary equipment, and relevant training.
NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE CITY
COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE; Competitive bidding for the purchase of an
Emergency Warning System serviceS, related equipment, and training for the City of
Jacksonville would be costly and non-productive, making said competitive bidding
unfeasible and impractical.
SECTION TWO: Competitive bidding is hereby waived, pursuant to
ACA §14-58-383, to authorize contracting for Emergency Warning System services,
related equipment, and training. Authorization is hereby given to the Mayor and
City Clerk to enter into a contract with Emergency Communications Network, Inc. of

Ormond Beach, Florida for the Warning Services through the CodeRED Warning
System, together with related equipment and training, all for a cost not to exceed
Nineteen Thousand Two Hundred Thirty-seven and 50/100 Dollars ($19,237.50),
together with any applicable tax.
SECTION THREE: All Ordinances, parts of Ordinances, or previous
actions taken by said Council in conflict herewith are hereby repealed to the extent
of such conflict.
SECTION FOUR: This Ordinance, necessary for the improvement of
public facilities and the health, safety, and welfare of the citizens of Jacksonville,
should be implemented immediately. Therefore, an emergency is hereby declared,
and this Ordinance shall be in force and effect from and after its date of passage.
