AN ORDINANCE MODIFYING JACKSONVILLE MUNICIPAL CODE § 3,08
(PURCHASING PROCEDURES); DECLARING AN EMERGENCY; AND, FOR OTHER
PURPOSES,
WHEREAS, Act 1189 of 2013 allows for increase of the procurement thresholds for
municipalities and other government entities, increasing the monetary values and
modifying the procedures to be followed for acquisitions and expenditures; and,
WHEREAS, after review of the City's applicable provisions, the City Council
recommend the following amendments be adopted for inclusion in the Jacksonville
Municipal Code to increase purchasing procurement thresholds currently imposed on the
City and provide appropriate procedures for implementation thereof.
NOW, THEREFORE, BEITORDAINEDANDENACTEDBYTHECITYCOUNCIL
OF THE CITYOFJACKSONVILLE, ARKANSAS, THAT, -
SECTION ONE. JMC § 3.08.010 [Expenditures up to Five Thousand
Dollars ($5,000.00)] shall be and hereby is amended to include the following:
[Expenditures up to Ten Thousand Dollars ($10,000.00)] Any and all expenditures
and/or purchases made on behalf of the City for the acquisition and/or purchase of
apparatus, equipment, labor, services, and/or supplies shall be made by the Mayor and/or
his/her duly authorized representative(s) without the necessity of obtaining bids or
quotation for those acquisitions, expenditures, and/or purchases not exceeding Ten
Thousand Dollars ($10,000.00).
SECTION TWO: JMC § 3.08.020 [Expenditures above Five Thousand
Dollars ($5,000.00) but below Ten Thousand Dollars ($10,000.00)] shall be and hereby is
amended to include the following:
[Expenditures from Ten Thousand Dollars ($10,000.00) to Fifty Thousand Dollars
($50,000.00)] Any and all expenditures and/or purchases above Ten Thousand Dollars
($10,000.00) but below Fifty Thousand Dollars ($50,000.00) made on behalf of the City for
the acquisition and/or purchase of apparatus, equipment, labor, services, and/or supplies
shall be made by the Mayor and/or his/her duly authorized representative(s) after obtaining
competitive written (in any applicable medium chosen) quotation bids from qualified
vendors of said apparatus, equipment, labor, services, and/or supplies.
SECTION THREE; JMC § 3.08.025 [Expenditures above Five Thousand
Dollars ($5,000.00) but below Ten Thousand Dollars ($10,000.00)] shall be repealed.

SECTION FOUR; JMC § 3.08.030 [Expenditures above Ten Thousand
Dollars ($10,000.00) but below Twenty Thousand Dollars ($20,000.00)] shall be repealed.
SECTION FIVE; JMC § 3.08.040 [Expenditures exceeding Twenty
Thousand Dollars ($20,000.00)] shall be and hereby is amended to include the following:
[Expenditures exceeding Fifty Thousand Dollars ($50,000.00)] Any and all
expenditures and/or purchases above Fifty Thousand Dollars ($50,000.00) made on behalf
of the City for the acquisition and/or purchase of apparatus, equipment, labor, services,
and/or supplies shall be made by the Mayor and/or his/her duly authorized
representative(s) after obtaining competitive sealed and written (in any applicable medium
chosen) quotation bids from qualified vendors of said apparatus, equipment, labor,
services, and/or supplies after publishing a legal advertisement in any local newspaper with
a minimum of One (1) publication. Bids received pursuant to said advertisement
publication shall be opened and read on the date set for receiving said bids in the presence
of the Mayor and/or his/her designated representative. The acquisition, purchase, and/or
contract shall be awarded to the lowest qualified and responsible bidder by the City
Council, though the Council may, upon motion, reject any and all bids received.
SECTION SIX,- JMC § 3.08.045 [Certain Exceptions] shall be created and
shall include the following:
All acquisitions, expenditures, and/or purchases made under JMC §§ 3.08.060 [State
Purchasing Contract], 3.08.070 [Reverse Internet Auction Option], and other applicable
provisions of 3.08 and/or State law shall be allowed should compliance be made with all
local, state, and federal purchasing procedures and requirements.
Any expenditures and/or purchases above Fifty Thousand Dollars ($50,000.00) not
awarded by competitive sealed bidding shall include both an Ordinance waiving competitive
bid and a written determination by the Mayor that the bidding process is not practicable nor
advantageous to the City.
SECTION SEVEN; All Ordinances or parts of Ordinances in conflict herewith
are hereby repealed to the extent of such conflict.
SECTION EIGHT,- If the City is to operate in an economical and efficient
manner, it is imperative that the purchasing requirements amended herein be implemented
as soon as practical. Therefore, to promote the public welfare, health, and safety, an
emergency is hereby declared to exist, and this Ordinance shall take effect as of January 1,
2014, as provided by and subject to the requirements of applicable law.
