REGULAR CITY COUNCIL MEETING - CITY HALL - #1 MUNICIPAL DRIVE The City Council of the City of Jacksonville, Arkansas met in Regular Session on September 15, 2005 at the regular meeting place of the Council. Alderman Stroud delivered the invocation and Mayor Swaim led a standing audience in the “Pledge of Allegiance” to the flag. ROLL CALL: Aldermen: Elliott, Smith, Lewis, Sansing, Ray, Rinker, Stroud, Twitty, and Howard answered roll call. Mayor Swaim also answered ROLL CALL declaring a quorum. PRESENT nine (9), ABSENT (1). Others present for the meeting were: City Attorney Robert Bamburg, Deputy Clerk Kary Jezwinski, Human Resource Director Charlie Brown, Public Works Director Jim Oakley, Fire Chief John Vanderhoof, Police Chief Robert Baker, Parks and Recreation Director George Biggs, CDBG Director Theresa Watson, Planning Commission Chairman Mark Stroud, Mrs. Judy Swaim, Mrs. Lendy Lewis, Mr. Larry Smith, interested citizens and members of the press. PRESENTATION OF MINUTES: Mayor Swaim presented the minutes of the regular City Council meeting of September 1, 2005 for approval and/or correction at the next regularly scheduled City Council meeting. APPROVAL AND/OR CORRECTION OF MINUTES: Alderman Smith moved, seconded by Alderman Howard that the minutes of the Regular City Council Meeting of 18 August 2005 be APPROVED. MOTION CARRIED. CONSENT AGENDA: REGULAR MONTHLY REPORT/ANIMAL CONTROL Alderman Elliott moved, seconded by Alderman Lewis to approve the Regular Monthly Animal Control Report for August 2005. Said report reflects: ADOPTION/FINES: 602.50 CONTRIBUTIONS: 0.00 TOTAL: $602.50 REGULAR MONTHLY REPORT/FIRE DEPARTMENT Alderman Elliott moved, seconded by Alderman Lewis to approve the Regular Monthly Report for August 2005 from the Jacksonville Fire Department, which reflects a fire loss of $21,500 and a savings total of $273,000. REGULAR MONTHLY REPORT/POLICE DEPARTMENT Alderman Elliott moved, seconded by Alderman Lewis to approve the Regular Monthly Report for August 2005. Said report reflects the Total Value of Reported Stolen Property $92,172. Total Value of Recovered Stolen Property $53,130 and Total Report Sales $381.00. CITY OF JACKSONVILLE REGULAR CITY COUNCIL MEETING SEPTEMBER 15, 2005 7:00 P.M. – 7:29 P.M. REGULAR MONTHLY REPORT/ENGINEERING Alderman Elliott moved, seconded by Alderman Lewis to approve the Regular Monthly Report for August 2005. WATER DEPARTMENT: WASTEWATER DEPARTMENT: FIRE DEPARTMENT: POLICE DEPARTMENT: STREET DEPARTMENT: Request to Accept Bid Street Striping Mayor Swaim noted that a bid from Time Striping was pulled because of a deficiency regarding the submitted paperwork. Alderman Stroud moved, seconded by Alderman Elliott to approve the low bid from Contractor’s Specialty in the amount of $25,536.91 with funds to be drawn from budgeted Street Funds. MOTION CARRIED. SANITATION DEPARTMENT: PARKS & RECREATION: PLANNING COMMISSION: a. FINAL PLAT Hayley Heights Subdivision Mayor Swaim noted that the subdivision is an outside the City subdivision within the City’s planning jurisdiction. He related that the Planning Commission was split regarding the waiver of sidewalks. Planning Commission Chairman Stroud noted that the requirement for sidewalks was waived but related that with the City expanding he feels the Planning Commission may need direction for requiring sidewalks in the outside the City planning jurisdiction. Alderman Smith, Lewis, and Ray expressed their support regarding the requirement of sidewalks in the outside the City planning jurisdiction. Mayor Swaim noted that the property is located on the far side of Hwy. 107, being significantly away from the existing City limits, but within the five-mile planning jurisdiction. In response to a question from Alderman Sansing, Mayor Swaim stated that the Master Street Plan does not carry any provisions for the area, adding that the projected growth is to the west and the Subdivision is located to the northwest. Alderman Sansing stated that if the Subdivision were in the projected growth area there would be more validation for requiring sidewalks, adding that if it does not appear that it could be incorporated within the next 20 years, that would be another thought process. He then stated that sidewalks help keep children off the streets regarding speeding vehicles. Mayor Swaim noted one difficulty regarding County subdivisions is that many times they are developed with open drainage ditches without curb and gutter, which is mostly accepted within the County and the County does not require those improvements. He stated that the City could make those requirements. He then related that this Subdivision is one that would have an open ditch, noting the difficulty for sidewalk placement. He noted the various considerations for determining a direction for sidewalk construction, adding that the City Council may want to meet with the Planning Commission for discussion regarding expectations for rural areas. He stated that developers would need to be given advance notice regarding any new requirement for sidewalks. Planning Commission Chairman Stroud explained that sidewalk, curb and gutter add expense to a development, which a developer would not want to incur in a rural area. He added that as the City reaches out, it would not want to impose requirements for one developer and not for another. Mayor Swaim noted that other developments in the five-mile jurisdiction have been approved without sidewalks. He noted a duplex development on Hwy. 89 that was approved without sidewalks. He stated that sidewalk regulations and consistency need to be considered. Discussion ensued regarding notification to developers during the front-end stages of development, if the City adopts sidewalks in the County. Alderman Stroud supported a joint meeting for the City Council and Planning Commission to decide the sidewalk issue as well as other items. Alderman Elliott suggested that the County Planning Board be invited to attend the joint session. CITY OF JACKSONVILLE REGULAR CITY COUNCIL MEETING SEPTEMBER 15, 2005 7:00 P.M. – 7:29 P.M. Alderman Ray mentioned the inconvenience for residents walking or walking their dogs without sidewalks It was concluded that the City Council would set a date at the next regularly scheduled City Council meeting to meet with the Planning Commission for a joint meeting. Alderman Smith moved, seconded by Alderman Howard to approve the Final Plat of Hayley Heights Subdivision. MOTION CARRIED. b. FINAL PLAT J.L. Sanders New Haven Subdivision Mayor Swaim noted that the Subdivision is also outside the City limits. Alderman Stroud moved, seconded by Alderman Smith to approve the Final Plat of the J.L. Sanders New Haven Subdivision. MOTION CARRIED. c. FINAL PLAT Growing Pines Subdivision PH II Mayor Swaim related that the Subdivision is located off Ray Road and Southeastern. Alderman Elliott moved, seconded by Alderman Stroud to approve the Final Plat of Growing Pines Subdivision PH II. MOTION CARRIED. d. ORDINANCE 1260 (#22-05) AN ORDINANCE RECLASSIFYING PROPERTY IN THE CITY OF JACKSONVILLE, ARKANSAS (GENERAL LOCATION: VALENTINE ROAD); AMENDING ORDINANCE NUMBERS 213 AND THE LAND USE MAP OF THE CITY OF JACKSONVILLE, ARKANSAS; AND, FOR OTHER PURPOSES. Mayor Swaim noted that the ordinance reclassifies 2 acres on Valentine Road from R-3 to R-1, as recommended by the Planning Commission. Alderman Stroud moved, seconded by Alderman Ray that Ordinance 1260 be placed on FIRST READING. ROLL CALL: Alderman Elliott, Smith, Lewis, Sansing, Ray, Rinker, Stroud, Twitty and Howard voted AYE. NAY (0). MOTION CARRIED. ORDINANCE APPROVED, ADOPTED AND NUMBER 1261 THIS 15th DAY OF SEPTEMBER 2005. CITY OF JACKSONVILLE REGULAR CITY COUNCIL MEETING SEPTEMBER 15, 2005 7:00 P.M. – 7:29 P.M. GENERAL: APPOINTMENT(S): ANNOUNCEMENT(S): Mayor Swaim commended the generosity of the Community regarding the Hurricane Rita relief efforts. He noted participation by the Aldermen and a recent meeting consisting of 117 participants from three states representing services such as Social Security, FEMA, HUD, Public Health and Insurance. He cited the superb volunteerism of Mary Lou Gall and Angie Mitchell who are manning the center up to ten hours a day. He noted that there are other volunteers helping in the center, encouraging others to volunteer. He related that Jacksonville’s Chamber of Commerce was quick to recognize the need in Jacksonville and began efforts for the original 40 families displaced in the City. He noted that donated items have been received in great numbers, but added that currently furniture items are needed to help the 58 families that have been placed in housing. He noted that cash donations have been generous and many furniture items have been purchased. He asked that anyone wishing to donate furniture items contact the center at 241-1103. He stated that some of the Jacksonville Hotels have donated mattresses, which have already been distributed to those families. He noted the generosity of Jacksonville residents who sponsored families in their homes until housing could be arranged and the generosity of property owners who offered as much as 6 months free rent. He stated that it has been a rewarding experience, adding that he feels the Jacksonville Community has risen to the occasion without a great deal of aid from outside the Community. He stated that the citizens of Jacksonville responded directly and are doing a great job. He then noted that there have been three job fairs; two were sponsored by the City of Jacksonville Human Resources Department with a number of evacuees being placed in jobs. He stated that many of the evacuees have expressed a desire to remain in Jacksonville. He related that the local churches have been very generous serving meals for the evacuees as well as the Fishnet Services. He stated that it is rewarding to see a community come together to address needs. He added that the City of Jacksonville is reviewing its evacuation and emergency plans to ensure readiness if a disaster were to occur. He expressed his experience with the evacuees as personally rewarding, pointing out that many evacuees have stated that they have never been in a community that was friendlier or more gracious than Jacksonville. Alderman Smith related that his church sponsored several families, making bedrooms of the church classrooms. He related that a member of one family worked at the Wal-Mart Supercenter in New Orleans and was able to transfer to the Jacksonville Wal-Mart Supercenter and has decided to remain in Jacksonville. CITY OF JACKSONVILLE REGULAR CITY COUNCIL MEETING SEPTEMBER 15, 2005 7:00 P.M. – 7:29 P.M. Alderman Stroud stated that it has been a blessing to help, adding that the evacuees have truly been appreciative of the help. He then stated the need to make a public apology to the City Engineer and Code Enforcement, referring to photographs supplied to the City Council at the previous meeting, saying that he did not mean to infer onus for those Departments. He then explained that his intention was to make the City Council more aware of needs to make the City more attractive and business friendly. Other acknowledgements were mentioned regarding contributions and donations to the Hurricane relief efforts including volunteerism from the Aldermen, a cash donation from the Gospel Tones, and $700.00 being raised by the children of Pinewood Elementary School. Alderman Twitty stated that the center is now in need of bottled water, toilet tissue, Kleenex and paper towels. Alderman Stroud recognized that Mayor Swaim opened the center on Labor Day and worked there all day.
