1041 1/ ORDINANCE NO. 1041 (15-95) AN ORDINANCE PROVIDING FOR THE SUBMISSION TO THE QUALIFIED VOTERS OF THE CITY OF JACKSONVILLE1 ARKANSAS I THE QUESTION OF INCREASING THE LEVY OF AN ANNUAL TAX SO AS NOT TO EXCEED SEVEN TENTHS OF ONE MILL ON THE ASSESSED VALUE OF THE REAL AND PERSONAL PROPERTY WITHIN THE CITY OF JACKSONVILLE FOR THE PURPOSE OF PAYING PENSIONS TO WIDOWS AND/OR MINOR CHILDREN OF DECEASED AND/OR DECEASED RETIRED FIREMEN AND TO RETIRED FIREMEN AND INCREASING THE LEVY OF AN ANNUAL TAX SO AS NOT TO EXCEED SEVEN TENTHS OF ONE MILL ON THE ASSESSED VALUE OF THE REAL AND PERSONAL PROPERTY WITHIN THE CITY OF JACKSONVILLE FOR THE PURPOSE OF PAYING PENSIONS TO WIDOWS AND/OR MINOR CHILDREN OF DECEASED AND/OR DECEASED RETIRED POLICEMEN AND TO RETIRED POLICEMEN; DECLARING AN EMERGENCY; AND I FOR OTHER PURPOSES. ----~----~---~~-------~-~----~---~--~------~~--~--~~~~--~---~ ---~---~~~------------------~--~--~~-~-------~-~---~~-------~ WHEREAS, the City of Jacksonville, Arkansas, is a City of the First Class and is authorized by Amendment 31 to the Constitution of the state of Arkansas to levy an annual tax not to exceed one mill on the dollar upon the assessed value of real and personal property in said City for the purpose of paying pensi ons to widows and minor chi 1 dren of deceased firemen; and, pensions to widows and minor children of deceased retired firemen; and pensions to retired firemen; WHEREAS, the City of Jacksonville, Arkansas, is a City of the First Class and is authorized by Amendment 31 to the Constitution of the state of Arkansas to levy an annual tax not to exceed one mill on the dollar upon the assessed value of real and personal property in said City for the purpose of paying pensions to widows and minor children of deceased policemen; and, pensions to widows and minor children of deceased retired policemen; and pensions to retired policemen; WHEREAS, the current levy of .5 mill for each Plan, approved by the voters in 1962 but reduced by reevaluation to .3 mi 11 for each Pl an by state and County governments in 1988, fails to provide sufficient income for the Pension Funds to become actuarialy sound. Insufficient funding will resul t in a deficiency upon the retirement of addi tional members of the Plans, with the Firemen's Plan currently at Forty-four Percent (44%) retired members and the Policemen's Plan currently at Fifty-two Percent (52%) retired members. NOW1 THEREFORE I BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE1 ARKANSAS I THAT: SECTION ONE: There shall be submitted to the qualified voters of the Ci ty of Jacksonvi 11 e / Arkansas, at a special el ection to be held on Thursday, the eighth day of June, 1995, the question of an increase to the levy of an annual tax not to exceed seven tenths of one mill on the dollar upon the assessed value of real and personal property within the City for the purpose of paying pensions to widows and minor children of deceased policemen, pensions to widows and minor children of deceased retired policemen, and pensions to retired policemen. SECTION TWO: There shall be submitted to the qualified voters of the City of Jacksonville, Arkansas, at a special 72.. SECTION THREE: follows: The ballot titles shall appear as "The Question of Increasing the Levy of an Annual Tax for the Purpose of Paying Pensions to Widows and Minor Children of Deceased Firemen Pensions to Widows and Minor Children of Deceased Retired Firemen, and Pensions to Retired Firemen, so as not to Exceed One Millon the Doll ar upon the Assessed Val ue of Real and Personal Property Within the City of Jacksonville, Arkansas." "FOR INCREASE OF FIREMEN'S PENSION MILLAGE" "AGAINST INCREASE OF FIREMEN'S PENSION MILLAGE" "The Question of Increasing the Levy of an Annual Tax for the Purpose of Paying Pensions to Widows and Minor Children of Deceased Policemen, Pensions to Widows and Minor Children of Deceased Retired Policemen, and Pensions to Retired Policemen, so as not to Exceed One Millon the Dollar upon the Assessed Value of Real and Personal Property Within the City of Jacksonville, Arkansas." "FOR INCREASE OF POLICEMEN'S PENSION MILLAGE" "AGAINST INCREASE OF POLICEMEN'S PENSION MILLAGE" SECTION FOUR: In the event of approval of said increase in tax levy by the qualified voters of the City of Jacksonvi II e I Arkansas, such steps shall be taken as are necessary to comply with the will of the citizens expressed in said election. SECTION FIVE: The City Clerk shall cause this Ordinance to be published and shall file a certified copy of this Ordinance with the County Board of Election Commissioners in order that this issue be placed on the Special Election Ballot for Thursday, June 8, 1995. SECTION SIX: All Ordinances or conflict with this Ordinance are hereby extent of that conflict. parts thereof repealed to in the SECTION SEVEN: Because condi tions affecting the Policemen's and Firemen's pensions needs are of such a timely nature, it is hereby necessary to the heal th, safety I and wel fare of the ci ti zens of Jacksonvi 11 e, Arkansas , that an emergency hereby be declared.
