1032 5'.0 o ORDINANCE NO. 1032 (115-94) AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE PURPOSE OF OBTAINING WATER WELL DR,ILLING SERVICES AND BULLDOZER SERVICES FOR THE GRAHAM ROAD AND ROGA"RS ROAD LANDFILL SITES; DECI,ARING AN EMERGENCY,. AND, FOR OTHER PURPOSES. -~~-~---~~----~-~---~-~~--~--~~-~~~~-~~-----~~---~-----~----~ ----~---~~~---~~--~-~-~~-~----~-~~--~-~-~~~~~-~--~-~~-~---~-- WHEREAS, in order to continue efficient cleanup and initiate monitoring service operation of the Graham Road and Rogers Road Landfills, a water well drilling service is needed; and, WHEREAS, because of the extensi ve requirements of the Consent Decree, weather conditions and limited availability of such expertise and equipment I only one supplier in the Celltral Arkansas area can meet tJ:le specifications alld time frame required in order to comply with the necessary restrictions. NOW I THEREFORE, BE IT ORDAINED BY TH.E CITY COUNCIL OF' THE CITY OF JACKSONVILLE, ARKANSAS, THAT: SECTION ONE: Competi ti ve bidding for the purpose of obtaining water well drilling services for use in the Jacksonvi 11 e Graham Road and Rogers Road Landf i 11 wOl.ll d be cost 1 y and non-producti ve! making said competi ti ve bidding unfeasible and impractical. 21)3 ~:S )J) SECTION TWO: Competitive bidding is hereby waived, pursuant to Arkansas Code Annotated, 14--58....~ / t.o obtai11 water well drilling services for the Graham Road and Rogers Road 1 andf i 11 S to Author i za ti orl is hereby gi ven to the Ci ty Engineer to enter into an agreement with either Diversified Drilling of El Dorado, Arkansas, or Grubbs, Garner, and Hoskyn., Inc., of Little Rock, Arkansas, to obtain said water well drilling services at a total cost of approximately Fifteen Hundred Dollars ($1,500.00) up to a maximum of Five Thousand Dollars ($5,000.00) per well, with said amount to be negotiated by the City Engineer and Public Works Director per the final directives of EPA officials regarding testing and drilling requirements. SECTION THREE: Competitive bidding is also hereby waived, pursuant to Arkansas Code Annotated 14.-58-.383/ to lease a bulldozer and other equipment necessary to complete the tasks delegated to the City under the terms of the Consent Decree. Authori zation is hereby' gi ven to the Ci ty Engineer to enter into a lease agreement for said equipment with Central Arkansas Tractor Sales of Little Rock, Arkansas, at a rate of Six Thousand Five Hundred Dollars ($6,500*00) up to a maximum of Eight Thousand Dollars ($8,000.00) per month, together with all applicable transportation charges and permit fees, and dependent on the length of time said equipment shall be required to accomplish the obligations under the Consent Decree. SECTION FOUR: All Ci ty Ordinances or parts tllereof in conflict herewith are hereby repealed to the extent of said conflict. 5" Ordinance/No. 1032 (115-94) October < ~~, 1994 Page Two SECTION FIVE: Immediate implementation of the water well drilling services is necessary for compliance with the terms of the Consent Decree and weather condi tions. Therefore 1 an emergency is hereby decl ared, and this Ordinance shall take effect immediately upon passage and publication, as provided by and subject to the requirements of applicable law.
