ORDINANCE NO. 1027 (#10-94)
AN ORDINANCE WAIVING COMPETITIVE BIDDING FOR THE PURPOSE OF
PURCHASING A PATROL/NARCOTIC DOG FOR THE JACKSONVILLE POLICE
DEPARTMENT; DECLARING AN EMERGENCY; AND, FOR OTHER PURPOSES.

WHEREAS, it is necessary for the City to purchase
another patrol/narcotic dog to provide additional assistance
to the Narcotics division in its fight against drugs in our
community; and,
WHEREAS, there is currently one (1) European import dog
avai 1 abl e for training and sal e from Canine Unl imi ted in
Tulsa, Oklahoma. Canine Unlimited is recognized as a leader
in this field, having sold Jacksonville Police Department one
canine in the past. The Department and Ci ty have enjoyed
excellent results with said animal because of superior
breeding, training, and abilities, and an additional animal
will enhance the Department's effectiveness.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF JACKSONVILLE, ARKANSAS, THAT:
SECTION ONE: Competitive bidding for the purpose of
purchasing a new patrol/narcotic dog would be costly and non-
producti ve, making said competi ti ve bidding unfeasibl e and
impractical.

SECTION TWO: Competitive bidding is hereby waived, pur-
suant to Arkansas Code Annotated Section 14-58-~, for the
purpose of purchasing a new patrol/narcotic dog for the
Jacksonville Police Department. Authorization is hereby
given to the Chief of Police to enter into a contract with
Canine Unlimited of Tulsa, Oklahoma, to provide such a dog at
a price of Seven Thousand, Eight Hundred and 00/100 Dollars
($7 I 800 . 00) I seventy percent (70%) of whi ch is due imme-
diately. The remaining balance shall be paid upon completion
of training and delivery of said animal to the Department.
SECTION._THREE: This Ordinance shall take effect and be
in force from and after its passage.
SECTION. FOUR: All Ordinances and Resal utions, or parts
thereof, in conflict with this Ordinance are hereby repealed
to the extent of that conflict.
SECTION. FIVE: Immediate action on this purchase wi 11
act to diminish the negative effect drugs have on the safety
and wel fare of the ci ti zens of Jacksonvi 11 e. Therefore, an
emergency is hereby decl ared and this Ordinance shall take
effect immediately upon its passage and publication, as
provided by and subject to applicable law.
