The City Council of the City of Jacksonville, Arkansas met in Regular Session on, January 3, 1992, at the regular meeting place of the Council. Alderman Marshall Smith delivered the
invoca-tion after which Mayor Swaim led the standing audience in the "Pledge of Allegiance" to the flag.
ROLL CALL:
Aldermen: Knight, Smith, Sansing, Ray, Wilson, Williamson, Keaton and Twitty were present. Alderman Lewis and Fletcher were absent. PRESENT, Eight (8), ABSENT, (2). Mayor Swaim also
answered ROLL CALL and declared a quorum.
Others present for the meeting: City Attorney Robert E. Bamburg, Personnel Director and Mayoral Aide Michael Beeman, Asst. Deputy City Clerk Teresa Parker, City Engineer Reel, Planning
Commission Chairman Bart Gray Jr., interested citizens and members of the press.
PRESENTATION OF MINUTES:
Mayor Swaim presented the minutes of the Regular City Council Meeting of December 19, 1991 for study and action at the next Regular City Council Meeting.
APPROVAL AND/OR CORRECTION OF MINUTES:
Alderman Ray moved, seconded by Alderman Sansing that the minutes of the Regular City Council Meeting of December 5, 1991 be APPROVED. MOTION CARRIED.

Mayor Swaim pointed out that a Public Hearing will be held later in the meeting and continued with the next item of business.
b. PRESENTATION OF LAND USE MAP/REQUEST TO SET A PUBLIC HEARING
City Engineer Reel was recognized to address the item of busi-ness.
He pointed out that the Planning Commission has worked on the map for approximately six months and that some areas have been changed from residential to commercial. He said that
commercial areas as indicated on the map were set up as follows: along Hwy 161 from Gregory Place Shopping Center south to Valentine Road, on the intersection of Loop Road and Graham
Road, on the inter-section of Harris Road and General Samuels Road, at the intersec-tion of Harris Road and West Main Street, from Quince Hill Road south all the lands on the west
side of Toneyville Road, south of Gregory Place on the west side, from Martin Street south on the east side, Military Road at Hwy 161 south to Cloverdale Road, an area at the intersection
of General Samuels and Hwy 107, from Coffelt Crossing south approximately one-half mile section on the east side.
He said that the flood plain is not indicated as such on the map except by approximation.
He said the suggested land use as presented in the map fit into the development scheme of the City of Jacksonville.
He pointed out that no rezoning is being done in the changes suggested, only that the lands will be eligible for rezoning.
Mayor Swaim voiced that Metroplan worked with the Planning Com-mission and the City Engineer in the map design adding that the City of Jacksonville pays a certain amount of dues
annually for such services.
Mayor Swaim commended the work of the Planning Commission.

Mayor Swaim set a public hearing for February 6, 1992 at 7:45 p.m. to address the Land Use Map for input by the general public and action by the City Council.

Alderman Smith moved, seconded by Alderman Wilson that Mr. Tad Green, Mr. Art Brannen and Mr. Frank Dowd be appointed to the Planning Commission for terms to expire 1/1/1995.

ANNOUNCEMENTS:
a. PRESENTATION OF THE STATE OF THE CITY REPORT at the next City Council Meeting
b. PUBLIC HEARING to be held FEB. 6, 1992 at 7:30 p.m. / Ref: WASTEWATER UTILITY RATE INCREASE
Mayor Swaim encouraged attendance by the citizens of Jacksonville in the matter of the rate increase.
c. CODE OF ETHICS FORMS
Mayor Swam recognized City Attorney Robert E. Bamburg to address the matter of who is to file the Code of Ethics and Financial Statements of Interest.
He said that commissioners who are not paid by the City are supposed to file the Code of Ethics forms with the City Clerk, and that the Mayor, the City Attorney, the Municipal
Judge, the City Clerk and the Aldermen are to file the Financial Statements. He said it has been the practice for the City of Jacksonville that elected officials file both with
the City Clerk by January 31 of each year.

City Engineer Reel was recognized by Mayor Swaim to address the item of business.
He made the Council aware of the location of the streets, voicing that they were never developed as shown in the original town plat and that the city has no interest in building the
streets and that the Planning Commission has recommended said closings.
Mayor Swaim declared the Public Hearing open at approximately 7:20 p.m.
There were no comments from those present in opposition to the street closings.
Mayor Swaim closed the Public Hearing at approximately 7:22 p.m.
Alderman Smith moved, seconded by Alderman Sansing that Stone Street and Park Street be closed as requested. MOTION CARRIED.

AN ORDINANCE VACATING AND CLOSING STONE STREET IN THE CITY OF JACKSONVILLE, ARKANSAS, (GENERAL LOCATION: BETWEEN ELM STREET AND OAK STREET); AND, FOR OTHER PURPOSES.
Alderman Wilson moved, seconded by Alderman Ray, that Ordinance be placed on FIRST READING. ROLL CALL: Aldermen: Knight, Smith, Sansing, Ray, Wilson, Williamson, Keaton and Twitty
voted AYE. NAY (0). Motion received eight (8) affirmative votes, (0) negative votes. MOTION CARRIED. Ordinance read FIRST TIME by City Attorney Robert E. Bamburg.
Alderman Ray moved, seconded by Alderman Knight to suspend the rules and dispense with the reading of the ordinance in full. MOTION CARRIED.

Mayor Swaim stated that DPC&E had approved issuing a permit to burn the dioxin waste at the Vertac Chemical Plant at noon the third of January, 1992 and that the approximate
time given to complete the burn is one year.
