A II: 24 . , ,C, M~,5 'lL v, i~it ,tl\', E' V {ltn....'.... f r<\,.... \w' I n L d I T CO lJ l~ T)I C L E' n J< 99-02~j235 ORDINANCE NO. 1117 (#3 - 99) AN ORDINANCE VACATING AND CLOSING NIXON, THOMAS, AND A PORTION OF PARRISH STREETS, JACKSONVILLE, ARKANSAS (GENERAL LOCATION: THOSE PORTIONS OF NIXON AND THOMAS STREETS LYING EAST OF BAILEY BOULEVARD AlVD THE FIRST SEVENTY-FIVE FEET (751 OF PARRISH STREET LYING IMMEDIATELY EAST OF BAILEY BOl!LEVARD); AND, FOR OTHER PlJKPOSES. -------------------------------------------------------------- -------------------------------------------------------------- WHEREAS, the Jacksonville Planning Commission has reviewed the proposed closures and abandonment of NIXon and Thol11as Streets lying east of Bailey Boulevard and the proposed closure of the first Seventy-five feet (75') of Parrish Street lying immediately East of Bailey Boulevard. The Commission, after thorough review and study, has no opposition to the street closures subject to replacement of various municipal utility easements needed for said property; and, WHEREAS. the Jacksonville City Council hosted public hearings regarding said c~osures on December 17, 1998, January 7, 1999, and continueo said public hearings on February 4, 1999, with notice duly pu blished as required by law. At said hearings, the written approval of all adjacent property owners was presented and utility cOlllpanies expressed consent to tlie closing of said streets, subject to reservation of easement rights for said utilities. NOW, THEREFORE, BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS: SECTION ONE: The real property, more particularly described as follows is: The streets located in the Little Rock Air Force Base Main Gate Development Area (Recorded in Plat Book 5, Page 8, Pulaski County Court House, Little Rock, Arkansas), more particularly described as follows: Thomas Street from the East right-of-way line of Bailey Boulevard to the West right-of-way line of U. S. Highway 67- . 1670 And Nixon Street from the East right-of-way line of Bailey Boulevard to the West right-of-way line ofU. S. Highway 67-167. And Seventy-five feet (75') of Parrish Street lying immediately East of Bailey Boulevard. (GENERAL LOCATION: Nixon and Thomas Streets and the first Seventy-five teet (75') of Parrish Street lying East of Bailey Boulevard, Jacksonville, Arkansas. ) Said property is hereby closed and vacated under the powers granted to cities of the first class in the State of Arkansas, subject to reservation of easement rights and privileges for private and municipal utility companies. The Mayor and City Clerk are hereby duly authorized and directed to enter into an agreement with those adjOIning and abutting property owners of Nixon, Tnomas, and that portion of Parrish Streets lying east of Bailey Boulevard affected by this c10sure. The agreement shall close and abandon \ \ I( Ordinance No. 1117 (#3 - 99) Page Two said street right-of-ways, with the real property described reverting to said property owners in accordance with state law. SECTION TWO: A copy of this Ordinance duly certified by the City Clerk, shall be filed in the OffIce of the Recorder of the County and recorded in the Deed Records of the County, hereby amending the plat recorded on November 1, 1920, in the PulaskI County Circuit Clerk Records. SECTION THREE: All Ordinances, ")arts of Ordinances, or previous actions taken by said Council in con~lict herewith are hereby repealed to the extent of such conflict. SECTION FOUR: This Ordinance shall take effect and be in force from and after its passage.
