AN ORDINANCE AMENDING ORDINANCE NO. I 084 (# I 2-97), CODIFIED AS
JACKSONVILLE MUNICIPAL CODE 62.46.010, REQUIRING INDEPENDENT

CANDIDATES WITH THE PULASKI COUNIYCLERK NO LATER THAN NOON OF
THE DA Y BEFORE THE PREFERENTIAL PRIMARY ELECTION; ESTABLISHING A
MI:..IHOD OF PUBLICATION OF SAID PROVISIONS IN COMPLIANCE WITH ACA
6 I 4-42-2 06 (E) (I); AND FOR OTHER PURPOSES.
WHEREAS,
A 1997 REVISION OF ARKANSAS STATUTES PROVIDE THAT THE
GOVERNING BODY OF FIRST CLASS MUNICIPALITIES MAY ENACT AN ORDINANCE REQUIRING
INDEPENDENT CANDIDATES FOR MUNICIPAL OFFICE TO FILE PETITIONS FOR NOMINATION AS
INDEPENDENT CANDIDATES WITH THE COUNTY CLERK, RATHER THAN THE BOARD OF ELECTION
COMMISSIONERS, NO LATER THAN NOON OF THE DAY BEFORE THE PREFERENTIAL PRIMARY
ELECTION IN COMPLIANCE WITH ACA 9 I 4-42-206(E)(I); AND,
WHEREAS,
THE 0ACKSONVILLE CITY COUNCIL BELIEVES IT IS IN THE BEST
INTEREST OF ALL CITIZENS TO REQUIRE INDEPENDENT CANDIDATES FOR MUNICIPAL OFFICE TO
FILE PRIOR TO THE PREFERENTIAL PRIMARY ELECTION SO THAT VOTERS ARE INFORMED AND
AWARE OF ALL CHOICES AVAILABLE WHEN ELECTING THEIR MUNICIPAL OFFICIALS.
NOW: THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
JACKSONVILLEg A RKANSAS1 THAT:
SEL;l ION ONE: 0MC 92.46.0 I 0 IS HEREBY AMENDED TO READ AS FOLLOWS:
I NDEPENDENT CANDIDATES FOR MUNICIPAL OFFICE WITHIN THE CITY OF 0ACKSONVILLE,
ARKANSAS, ARE HEREINAt' IER REQUIRED TO FILE PI::.IITIONS FOR NOMINATION AS INDEPENDENT
CANDIDATES WITH THE PULASKI COUNTY CLERK OR DESIGNATED OFFICIAL AS MANDATED BY
STATE STATUTE. SAID PI::.IITIONS ARE TO BE FILED NO LATER THAN NOON OF THE DAY BEFORE
THE PREFERENTIAL PRIMARY ELECTION TO BE HELD IN SAID CITY.
SECTION TWO: THIS ORDINANCE SHALL BE PUBLISHED ONCE A WEEK FOR TWO
(2) CONSECUTIVE WEEKS IMMEDIATELY FOLLOWING THE ADOPTION OF THIS ORDINANCE IN AN
AREA NEWSPAPER HAVING GENERAL CIRCULATION WITHIN THE CITY OF 0ACKSONVILLE.
SECTION THREE: IF THIS ORDINANCE OR ANY PORTION THEREOF ARE DECLARED
VOID OR UNCONSTITUTIONAL FOR ANY REASON, IT SHALL NOT AFFECT THE REMAINING
PORTIONS OF THIS ORDINANCE NOT DECLARED UNCONSTITUTIONAL.
SECTION FOUR:
ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH ARE HEREBY REPEALED TO THE EXTENT OF SAID CONFLICT.
