1085 ~c; ORDINANCE NO. 1085 <# I 3 - 97) AN ORDINANCE PROVIDING FOR THE LEVY OF A ONE PERCENT ( I %) SALES AND USE TAX FOR FOJ-(IY-TWO (42) MOIvIHS WITHIN THE CI7Y OF JACKSONVILLE, ARKANSAS; PRESCRIBING OTHER MAilERS PEHIAINING THERl:..IO; AND, FOR OTHER PURPOSES. WHEREAS, THE CITY COUNCIL OF THE CITY OF 0ACKSONVILLE, ARKANSAS, HEREINAt' I ER REFERRED TO AS "CITY", HAS DETERMINED THAT THERE IS A GREAT NEED FOR CAPITAL MAINTENANCE IMPROVEMENTS TO THE 0ACKSONVILLE WASTEWATER UTILITY SYSTEM AND PLANT AND FOR A SOURCE OF REVENUE TO FINANCE SUCH IMPROVEMENTS; AND, WHEREAS, ACA 9 14-164-340, AS AMENDED (THE "AUTHORIZING LEGISLATION") PROVIDES FOR THE LEVY OF A ONE PERCENT ( 10/0) CITYWIDE SALES AND USE TAX FOR SUCH CAPITAL MAINTENANCE IMPROVEMENTS FOR A MAXIMUM OF FORTY-TWO (42) MONTHS. NOW: THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF JACKSONVILLE, ARKANSAS, THAT: SECTION ONE: UNDER THE AUTHORITY OF THE AUTHORIZING LEGISLATION, THERE IS HEREBY LEVIED A ONE PERCENT ( 10/0) TAX FOR FORTY-TWO (42) MONTHS ON THE GROSS RECEIJ-'IS FROM THE SALE AT RETAIL WITHIN THE CITY ITEMS WHICH ARE SUB'-'ECT TO THE ARKANSAS GROSS RECEIPTS ACT (ACA 926-52- I 0 lET. SEQ.) AND THE IMPOSITION OF AN EXCISE (FOR USE) TAX ON THE STORAGE, USE, DISTRIBUTION, OR OTHER CONSUMPTION WITHIN THE CITY OF TANGIBLE PERSONABLE PROPERTY SUB'-'ECT TO THE ARKANSAS COMPENSATING TAX ACT (ACA 926-53-10 lET. SEQ.), AT A RATE OF ONE PERCENT (10/0) OF THE SALE PRICE OF THE PROPERTY OR, IN THE CASE OF LEASES OR RENTALS, OF THE LEASE OR RENTAL PRICE (COLLECTIVELY, THE "SALES AND USE TAX"). THE SALES AND USE TAX SHALL BE LEVIED AND COLLECTED ONLY ON THE FIRST Two THOUSAND FIVE HUNDRED DOLLARS <$2,500) FOR EACH SINGLE TRANSACTION. SECTION TWO: ALL ORDINANCES AND PARTS THEREOF IN CONFLICT HEREWITH ARE HEREBY REPEALED TO THE EXTENT OF SUCH CONFLICT. SECTION THREE: THIS ORDINANCE SHALL NOT TAKE EFFECT UNTIL AN ELECTION IS HELD ON THE QUESTION OF LEVYING THE SALES AND USE TAX (TENTATIVELY SCHEDULED FOR NOVEMBER I 8, 1997), AT WHICH A MAJORITY OF THE ELECTORS VOTING ON THE QUESTION SHALL HAVE APPROVED THE LEVY OF THE SALES AND USE TAX AS OUTLINED ABOVE.
