AN ORDINANCE WAIVING COMPETITIVE BIDDING BY THE CITY OF
JACKSONVILLE, ARKANSAS, FOR THE PURCHASE OF FORTY-THREE
THOUSAND FOUR HUNDRED SEVENTY-EIGHT (43,478) SQUARE YARDS
OF TENSAR (I.E., SOIL REINFORCEMENT MATERIALS) FOR THE
JACKSONVILLE SHOOTING RANGE PROPERTY; DECLARING AN
EMERGENCY; AND, FOR OTHER PURPOSES,
WHEREAS, because of unstable soil conditions, the Shooting Range property
is in need of additional Soil Reinforcement Materials for construction of certain
improvements; and,
WHEREAS, the City has found satisfactory Soil Reinforcement Materials (i.e.,
Tensar) at a rate of One and 15/100 Dollars ($1.15) per Square Yard. As a result,
this is an opportunity to obtain the needed amounts of Soil Reinforcement Materials
at a reasonable cost to the City so as to allow for continued uninterrupted
construction of the City's new Shooting Range improvements.

SECTION ONE; Competitive bidding for the purpose of obtaining
Soil Reinforcement Materials (i.e., Tensar) product for the Jacksonville Shooting
Range property would be costly, non-productive, and time consuming, making said
competitive bidding unfeasible and impractical.
SECTION TWO; Pursuant to ACA § 14-58-303, competitive bidding
is hereby waived for the purpose of securing from the Capital Improvement Fund
Forty-three Thousand Four Hundred Seventy-eight (43,478) Square Yards of Soil
Reinforcement Materials (i.e., Tensar) for use in the construction of the City's new
Shooting Range improvements. Authorization is hereby given to the Mayor and/or
his designated representative to execute necessary documents for acquisition and
delivery of said Soil Reinforcement Materials (i.e., Tensar) with Contech Engineered
Solution LLC, of North Little Rock, Arkansas, at a rate of One and 15/100 Dollars
($1.15) per Square Yard for a total sum not to exceed Fifty Thousand Dollars
($50,000.00), plus applicable tax.

SECTION THREE; All Ordinances, parts of Ordinances, or previous
actions taken by said Council in conflict herewith are hereby repealed to the extent
of such conflict.
SECTION FOUR; This Ordinance, necessary for the Shooting Range
construction project to remain on schedule and accommodate the proposed growth
of the City and its citizens' health, safety, and welfare, should be implemented
immediately. Therefore, an emergency is hereby declared, and this Ordinance shall
be in force and effect from after its date of passage.
