1490ORDINANCE NO, 1490 (#21-2013) AN ORDINANCE WAIVING COMPETITIVE BIDDING BY THE CITY OF JACKSONVILLE, ARKANSAS, FOR THE TRANSPORT OF EIGHTEEN THOUSAND (18,000) TONS OF CLASS 7 AGGREGATE FILL FOR THE JACKSONVILLE SHOOTING RANGE PROPERTY; DECLARING AN EMERGENCY; AND, FOR OTHER PURPOSES, WHEREAS, because of unstable soil conditions, the Shooting Range property is in need of additional Class 7 Aggregate fill for construction of certain improvements; and, WHEREAS, the City has found satisfactory transportation of the Class 7 Aggregate fill product at a rate of Four and 25/100 Dollars ($4.25) per Ton. As a result, this is an opportunity to transport the needed amounts of fill product at a reasonable cost to the City so as to allow for continued uninterrupted construction of the City's new Shooting Range improvements. BEITORDAINEDANDENA CTED8YTHE CITY COUNCIL OF THE CITY OFJACKSONVILLE, ARKANSAS. SECTION ONE; Competitive bidding for the purpose of obtaining transportation of Class 7 Aggregate product for the Jacksonville Shooting Range property would be costly, non-productive, and time consuming, making said competitive bidding unfeasible and impractical. SECTION TWO; Pursuant to ACA § 14-58-303, competitive bidding is hereby waived for the purpose of securing from the Capital Improvement Fund transportation of Eighteen Thousand (18,000) Tons of Class 7 Aggregate fill for use in the construction of the City's new Shooting Range improvements. Authorization is hereby given to the Mayor and/or his designated representative to execute necessary documents for transportation of said Class 7 Aggregate with Chambers & Son Trucking, of Sherwood, Arkansas, and/or Jeff Smith Transport, of Ward, Arkansas, at a rate of Four and 25/100 Dollars ($4.25) per Ton, for a total sum not to exceed Seventy-six Thousand Five Hundred Dollars ($76,500.00). G0'? 0 Ordinance No. 1490 (#21-2013) Page Two SECTION THREE: All Ordinances, parts of Ordinances, or previous actions taken by said Council in conflict herewith are hereby repealed to the extent of such conflict. SECTION FOUR: This Ordinance, necessary for the Shooting Range construction project to remain on schedule and accommodate the proposed growth of the City and its citizens' health, safety, and welfare, should be implemented immediately.
