AN ORDINANCE WAIVING COMPETITIVE BIDDING BY THE CITY OF
JACKSONVILLE, ARKANSAS, FOR THE PURCHASE OF EIGHTEEN
THOUSAND (18, 000) TONS OF CLASS 7 AGGREGATE FOR THE
JACKSONVILLE SHOOTING RANGE PROPERTY; DECLARING AN
EMERGENCY; AND, FOR OTHER PURPOSES,
WHEREAS, because of unstable soil conditions, the Shooting Range property
is in need of Class 7 Aggregate for construction of certain improvements; and,
WHEREAS, the City has found satisfactory Class 7 Aggregate product readily
available at a rate of Six and 75/100 Dollars ($6.75) per Ton. As a result, the City
has an opportunity to purchase the needed amounts of fill at a reasonable cost to
the City so as to allow for continued uninterrupted construction of the City's new
Shooting Range improvements.

SECTION ONE; Competitive bidding for the purpose of obtaining
satisfactory Class 7 Aggregate fill product for the Jacksonville Shooting Range
property would be costly, non-productive, and time consuming, making said
competitive bidding unfeasible and impractical.
SECTION TWO; Pursuant to ACA § 14-58-303, competitive bidding
is hereby waived for the purpose of purchasing from the Capital Improvement Fund
Eighteen Thousand (18,000) Tons of Class 7 Aggregate fill for use in the
construction of the City's new Shooting Range improvements. Authorization is
hereby given to the Mayor and/or his designated representative to execute
necessary documents with Granite Mountain Quarry, 1010 Shamberger Lane, Little
Rock, Arkansas, for purchase of said product at a rate of Six and 75/100 Dollars
($6.75) per Ton, total sum not to exceed One Hundred Twenty-one Thousand Five
Hundred Dollars ($121,500.00), plus applicable tax.
SECTION THREE; All Ordinances, parts of Ordinances, or previous
actions taken by said Council in conflict herewith are hereby repealed to the extent
of such conflict.

SECTION FOUR: This Ordinance, necessary for the Shooting Range
construction project to remain on schedule and accommodate the proposed growth
of the City and its citizens' health, safety, and welfare, should be implemented
immediately. Therefore, an emergency is hereby declared, and this Ordinance shall
be in force and effect from after its date of passage.
